Raízen Energia confirms that it has service contracts with Construtora Ecman, but explains that they were revoked, stating that the bankruptcy request is unfounded.
Through a statement issued last Friday, (13/01), through the Securities and Exchange Commission, Raízen (RAIZ4) countered questions raised by B3. In which the arrangement referred to a bankruptcy filing by Raízen Energia, requested by the construction company Ecman. However, the Brazilian company in the sector energetic, denies that such a request is invalid.

According to the document signed by Carlos Alberto Bezerra de Moura, Raízen's financial and investor relations director, the company had not yet been legally informed about the incident.
However, there was confirmation that Raízen Energia had service provision contracts with the construction company Ecman, which were revoked on November 30th. According to Carlos Alberto, the reason for canceling the contracts was default by the construction company.

According to the executive, Ecman would have issued securities without due consideration. Due to this, Raízen requested in court the interruption of securities in the amount of R$ 25 million.
The court also requested that the construction company be prohibited from protesting titles related to the contracts established between the two companies, under penalty of a fine.
"The company understands that the bankruptcy petition is manifestly unfounded and clarifies that the amount of amounts under discussion has no material impact on its business, considering the equity situation of Raízen Energia", states the document.
Ecman, in turn, sent a note to the Valor Econômico newspaper in which it declares that all securities presented represent services provided, supported by technical and accounting documentation.
Also according to the text, the bankruptcy filing was made because Raízen would have refused to recognize and pay for the services provided.
“Constructora Ecman strictly followed the legal and ethical precepts in conducting all dealings in this regard”, said the company. The note also emphasizes that the documents will be examined in the process.
Energy company rejects bankruptcy filing in statement
Raízen adds that even the injunction against Ecman has already been declared.
Two factors are presented in the statement: “i) Suspension and suspension of all effects of protests filed against Raízen Energia by Ecman (approximately R$25 million); ii) Ecman refrain from protesting titles related to the contracts that were signed between the parties, under penalty of a fine, since the Court understood that there are indications of the issuance of invoices without ballast in the provision of services”.
The company brings again that the bankruptcy filing is "manifestly unfounded" and explains that the amount under discussion has no impact on its business, considering the total equity of Raízen Energia.
