Procon-SP applies historic penalty after disrespecting the “Do Not Call Me” registry
O Banco Pan S/A was fined R$ 13.522.436,17 by the Procon-SP for continuing to make telemarketing calls to consumers who were already registered in the program “Don’t Call Me”. The penalty is considered one of the largest ever applied by consumer protection agency in the State of São Paulo, according to the website Correio 24 horas.
What motivated the fine to the Bank?
The violation occurred because the bank continued to call users who had requested that commercial calls be blocked. legal period of 30 days, counted from the registration in the system, was ignored by the financial institution.
According to Procon-SP, this is a serious violation of the right to privacy and consumer peace of mind.
How was the penalty calculated?
The sanction was applied based on three fundamental criteria that guide the accountability of companies in cases of violation of consumer rights. The first criterion considered was the severity of the offense, which assessed the negative impact of the practices adopted by Banco Pan on the consumers involved.
Then, the following was taken into account: economic size of the institution, that is, its financial capacity and structure, which directly influences the definition of the value of the penalty.
