The National Social Security Institute (INSS) is one of the most important pillars of the Federal Government, responsible for guaranteeing the payment of pensions and various benefits for millions of Brazilians, whether they are retired due to disability, age, contribution time, among others. However, a new law proposed by ministers Simone Tebet and Fernando Haddad could directly impact these benefits., with potential cuts that worry many policyholders. Understand what is at stake and how this new legislation may affect INSS beneficiaries.

Tebet and Haddad's law could cut R$10 billion in INSS benefits

In recent times a fine-tooth comb is reaching INSS benefits granted by the Government to retirees, as is the case of Continuous Cash Benefit (BPC) and aid. The big reality is that, at the moment, the Ministry of Planning, Simone Tebet, is seeking to review spending and the Ministry of Finance, Fernando Haddad, is trying to eliminate the public deficit and the government agency is preparing a package of measures to generate savings of at least R$10 billion by 2024.

The government, on several occasions, has also proposed provisional measures or bills that aim to optimize Social Security resources, such as MP 871 / 2019 (which became the Law 13.846 / 2019), aimed at combating social security fraud.

It is worth mentioning that, the information comes from the president of the institution, Alessandro Stefanutto, in an interview with O GLOBO. Among the INSS benefits targeted by Tebet and Haddad's new law are: sickness benefit, the Continuous Benefit Payment (BPC) and the closed season insurance, intended for artisanal fishermen.

Also on the list is the expansion of the so-called Atestmed, which allows you to obtain sickness benefit for absences of up to 180 days based on a certificate without the need for a medical examination, and the appointment of civil servants through public examinations.

Atestmed, which began last year, has enormous potential to address one of the bottlenecks of the INSS, which is medical expertise. Half of the savings projected for 2024 should come from this mechanism that allows for reduced spending on retroactive payments.

INSS benefit spending reaches R$1 trillion

In all cases, the president of INSS hopes that the fine-tooth comb to filter retirees will be “surgical” and focus mainly on benefits with suspected irregularities or fraud detected by the system.

In view of the irregularities, the minister Simon Tebet, like Haddad, stated that the federal government's desire is to thoroughly investigate fraud and errors in INSS benefits for retirees. She pointed out a “significant jump” in beneficiaries in 2021 and 2022, causing the benefits paid to reach R$1 trillion.

In theory, the expectation of the new, stronger Tebet and Haddad Law is about the desire to reduce Federal Government spending and put an end to fraud, thus guaranteeing benefits for those who really need them.

It is worth highlighting that the Continuous Benefit Payment (BPC), provided for in the Organic Law of Social Assistance (Loas), is the guarantee of a minimum wage per month, currently R$ 1.412, to the elderly aged 65 or over or to a person with a disability of any age.

More than 45 thousand INSS benefits for retirees have already been canceled

Social Security Minister Carlos Lupi says that Tebet and Haddad's new law on temporary benefits, especially sickness benefits, has already identified undue payments to 45 people. According to him, this number represents 45% of the total benefits that have been reviewed.

According to Lupi, the most common cases are of people who recover their ability to work, but continue to receive assistance.

There is a considerable number of beneficiaries who return to the job market and do not inform the INSS. The review of benefits began just over a month ago. Around 1 payments have already been analyzed and another 100 are expected to be reviewed by the end of the year.
