Councilor Marlon Luz proposes changes to the Bill that include rate limits for Uber and other benefits for app drivers.

Get ready for a drastic change in the ride-hailing scenario! São Paulo city councilman Marlon Luz has come out swinging and presented a new text for PLP 12, which promises to shake up the market. And if you thought that platforms like Uber could continue with the old practice of charging absurd fees of up to 50%, you can breathe a sigh of relief. The new project aims to limit this bite to 25%, ensuring more justice in drivers' pockets.

This Thursday (12), councilor Marlon Luz, from São Paulo, presented a new text for Bill 12/2024, which promises to regulate the work of app drivers throughout Brazil. The proposal was delivered to the project's rapporteur, Congressman Augusto Coutinho, and brings significant changes to the category.

End of app drivers' unions

Among the main changes, Marlon highlights the end of the unions for app drivers, stating that they do not represent the class effectively. “Uber and other platforms will no longer be able to keep more than 25% of the value of rides“, said the councilor, who also made a point of highlighting the relief for workers who are already overburdened by high rates, which reach 40% or 50%.Nobody can stand these absurd rates anymore“, he emphasized.

IPI exemption on the purchase of new cars

The text proposes exemption from the Tax on Industrialized Products (IPI) on the purchase of new cars for app drivers, something that already happens with taxi drivers. Marlon explained that this measure is fair to equalize rights between categories.We are also guaranteeing credit with an interest rate half that of the market for the purchase of a new car.”, he added.

Another key point is the real autonomy of drivers, which, according to Marlon, was confusing in previous proposals. Now, the new text ensures that app drivers will have more control over their activities, promoting true independence.

Uber was against benefits offered by city halls, according to the councilor

The proposal also authorizes municipalities to register app drivers, which will allow them to offer benefits such as exemption from the blue zone and rotation. “Until now, Uber has taken legal action against these measures, but now municipalities will have more power to offer these benefits,” explained the councilor.

Mandatory toxicological examination

Finally, Marlon Luz announced that toxicology tests would be mandatory for app drivers. According to him, professionalization is the path to the valorization of the class.Uber and 99 prefer amateurs because it's cheaper for them.
