Minors holding a Driving Permit will be contemplated in the Child and Adolescent Statute Law
Bill 314/23 institutes the Brazilian Traffic Code (CBT) to issue Permission to Drive for young people over 16 years of age. For this to happen, the project provides for an amendment to Law No. 9.503, of September 23, 1997. In addition, it has specific inspections for minors. If the project is approved, minors holding a Driving Permit will be included in the Child and Adolescent Statute Law.
According to Traffic Portal, young people over 16 need to respect a limit during one year of permission so that they can obtain the definitive document. In this way, they cannot exceed: 20 points, if there are 2 or more serious infractions in the score; 30 points, if there is 1 very serious infraction in the score; and 40 points, if no serious infraction is included in the score.
Permission for those over 16 to drive can be justified by the political responsibility of young people
According to the author of the proposal, young people over 16 in the country live a constant process of maturation, since Brazil allows them to vote and actively participate in national political life. “Faced with such a finding, in which the active participation of young people in political life is admitted, it sounds incongruous that the ban on sixteen-year-olds from driving cars or motorcycles still persists"He says.

The deputy says that criminal liability, determined by the current Brazilian Traffic Code, is a requirement that needs to be broken. For him, "if it is not possible to apply the Criminal Law, applicable to adults, the Statute of the Child and Adolescent already provides for the characterization as an infraction of the described behaviors".

Allowing young people over the age of 16 to drive is a subject that has become increasingly frequent in the course of both the Chamber of Deputies and the Federal Senate. However, bills on the subject have not made much headway. O 3973 / 19 Bill, for example, which is being discussed in the Federal Senate, had the opinion of the Committee on Constitution, Justice and Citizenship for rejecting the project.
Senator Fabiano Contarato (PT/ES) states that “despite the obvious popular appeal, the inclusion of young people between the ages of 16 and 18 as drivers of motor vehicles, given the factual situation of Brazilian traffic, would be nothing short of reckless”. For him, the violent traffic in Brazil would be a stage for the occurrence of accidents with young teenagers behind the wheel.
