The bill that prohibits the state of Mato Grosso (MT) from charging taxes on solar energy was approved. The old text, which opened gaps for outside interpretations, will be changed
In the second vote, the deputies approved the bill that prohibits MT from charging taxes on solar energy. The session took place at the Legislative Assembly of Mato Grosso (ALMT), last Wednesday (26), and had 17 votes in favor.

Authored by Deputy Faissal, the bill amends the end of art. 37 da Complementary Law 631 / 2019 exemption from solar energy. According to Faissal Calil (PV), the current regulations have loopholes, allowing the State of MT to generate taxes on solar energy generation. Now, it will be fixed that until December 31, 2027, ICMS taxes will no longer be charged on solar energy in MT.
Consumers who use solar power plants and those who still intend to adhere to electricity from this source will have more legal certainty, without any type of tax on their bills, Faissal said.

The first vote on the Bill that taxed solar energy
In April of this year, the first vote for the revocation of ICMS collection was approved in Mt. In 2019, when the law was passed, there was an error in the text, causing loopholes to remain open allowing for unnecessary interpretations. In April, the government of Mato Grosso began taxing equipment that was used in solar energy, at the instigation of Energisa.
Faissal stated that this is a disorder and ALMT deputies cannot let this continue to happen. The new text will correct and clarify the current one, making sure there are no other interpretations or the benefit of a specific category.
The deputy also stated that if the MT government did not write a new text, it would be understood that the entities approve the undue tax rate on solar energy.
MT intends to advance more and more in the solar energy sector
According to data from Solar Portal, the State of MT has a region with a high insolation rate for solar energy, the Northeast of Mato Grosso has only about 6,35% of GDP, with 22 municipalities and about 248 thousand inhabitants, and an income of approximately R $ 3,7, an average well below other states, but these disadvantages do not leave the state behind in the sector of renewable sources, especially the solar energy source.
Mato Grosso will be the second state to be favored by the federal government this year in volume of investments, behind only Bahia, which will receive R$ 600 million. In all, there will be 17.794 new electricity connections that will mainly benefit municipalities in the North and Northeast regions of Mato Grosso that suffer daily from energy shortages, thus limiting their economic activities.
