The ICMS on solar energy in MT was revoked by parliamentarians. The correction of an error in the writing of the old text opened gaps for shady interpretations.
It was approved, in the first vote, by the Legislative Assembly of Mato Grosso (ALMT), the repeal of the collection of Tax on Circulation of Goods and Services (ICMS) on solar energy in Mato Grosso (MT).

About the vote on ICMS collection on solar energy
Presented this Wednesday (28) by the state deputy, Faissal Calil, at the ALMT, the Complementary Law No. 18/2021 which changes the text approved by the House in 2019, which is the collection of ICMS in relation to solar energy, the parliamentarian's proposal proposes the change after users point out that there was taxation on their electricity bills, for the month of April.

In the ALMT, the text that revokes the ICMS collection was unanimously approved. Faissal said in the gallery that the concessionaire responsible for the distribution of electricity in Mato Grosso (MT) would have provoked the state government to charge the ICMS tax to consumers who use solar energy and attribute it to energy tariffs.
Senator's words regarding Energisa's provocation
In 2019, when the law was passed, there was an error in the wording, leaving loopholes open for dubious interpretations and, in April of this year (2021), the state government began to tax solar energy equipment, under provocation by Energisa.
"This is a disorder and we cannot let this continue to happen," said Faissal. Therefore, this device will be changed so that Parliament does not become hostages of Confaz (National Council for Finance Policy). The PL that guarantees exemption from ICMS for solar energy was approved, considering that all parliamentarians from Mato Grosso (MT) are against the taxation of solar energy.
The new text only corrects and clarifies the old one, making other interpretations or the benefit of a specific category impossible. Faissal also stated that the state government of MT will have to approve the new ICMS text, otherwise it will be understood that the entities approve the undue taxation.
The Potential of MT in relation to Solar Energy
The northeast of Mato Grosso (MT) is a region that has a high rate of insolation for solar energy, according to studies carried out. However, the region has only 6,35% of the GDP, with 22 municipalities and approximately 248 thousand inhabitants, in addition to an income of approximately R$ 37 thousand, which is below the average for each state. Even with these disadvantages, the state is considered rich in renewable energy sources, in particular solar energy, as it is located in the Brazilian Midwest.
