The Instituto Combustível Legal (ICL), with its president Emerson Kapaz and director Carlo Faccio at the helm, is present at Expocom 2023 to draw attention to the relevance of the rapid approval of PLP 164 / 2022. The proposal, which aims to consolidate federal legislation against the stubborn debtor, is a hot topic in the debates at the fuel dealers fair in the states of Paraná, Santa Catarina and Rio Grande do Sul.
The future of the Brazilian market
Today, starting at 14:30 pm, Kapaz will illustrate the panorama of the “Future of the Fuel Market in Brazil”. Next, at 15:30 pm, Faccio will discuss the “Fight against the irregular market in the fuel sector”. Both discussions revolve around the relevance of PLP 164 / 2022, a tool that will enable states to implement Special Taxation and Inspection Regimes. The implementation aims to curb attitudes of companies and entrepreneurs that, deliberately, harm both public finances and the end consumer.
The scenario is alarming: the fuel sector has witnessed an evasion of more than R$100 billion due to tax evasion and default recently. Kapaz highlights that “R$14 billion is linked to accounting fraud and tax defaults, such as 'shell' companies to hide tax evasion”. This amount could have been used to benefit society, such as investments in education, health and security.

The need for federal consolidation
Although 15 states and the Federal District already have legislation aimed at classifying persistent debtors, the national scenario lacks uniformity. Carlo Faccio highlights the urgency of a “federal law to equalize standards of obligations and punishments across the country”.
In the intricate fiscal scenario, malicious individuals exploit loopholes for illegal activities, such as money laundering and operations linked to organized crime. Kapaz reinforces that “evaders obtain unfair competitive advantages in the fuel sector”.
For ICL, fair competition must be the guideline for all economic segments. Faccio concludes, pointing to a market increasingly threatened by sophisticated illegalities and unfair competition practices, which inhibit investments and compromise the state's tax collection capacity.
