The 300 million reais blocked by Engevix by the courts should be used to compensate for the damage caused to retirees of Caixa Econômica Federal

Despite Engevix leaving the “black list” and being able to resume business with Petrobras later this year, judge Vallisney de Souza Oliveira, from the 10th Criminal Court of the Judiciary Section of the Federal District, determined last Monday (28/09), the blocking of 300 million reais from the Engevix Group. The 300 million reais blocked by the court should be used to compensate for the damage caused to retirees from Caixa Econômica Federal, through deviations from Funcef, the pension fund for bank employees.

It will be the responsibility of shipbuilder Ecovix to pay R$ 100 million, resulting from the auction of the metallic structures of the P-71 oil platform. The other BRL 200 million refer to the sale of the São Roque hydroelectric plant, in Santa Catarina, with an installed capacity to produce 142MW (megawatts). About 80% of the works are completed.

In addition, the judge determined that Engevix cannot dispose of the plant “other than for sale to third parties during the entire period of the announced negotiation, and it is forbidden to pledge the asset to other creditors or carry out any type of transaction that implies the unavailability of the good”.

According to Nova Ecovix, the blockade made by the courts in the order of R$300 million was determined in 2016, as a guarantee to Funcef in case the group is convicted in Lava Jato investigations. According to the advisory, the amounts cannot be collected before the end of the process.

Funcef, on the other hand, claims that the judge blocked Engevix's assets to guarantee payment to the fund, since the company has not yet deposited the money

“Since 2019, Nova Participações has signed a leniency agreement with the Union and committed to the best management practices and to the payment of 516 million reais, which it has been royally fulfilling. It is necessary to explain that Funcef had a 25% stake in the Rio Grande Shipyard. It turns out that the company entered into judicial recovery at the end of 2016, resulting in the stoppage of platform construction activities. Funcef's interests in the shipyard have been dealt with in the context of judicial recovery and the Court of Justice of the State of Rio Grande do Sul. Therefore, there is a conflict of powers, which will be clarified to the judge in Brasilia when the group is duly notified about the decision.

As for Funcef's investments in the energy company DESENVIX Fontes Renováveis, in which the fund still holds an 18% stake in the company, it is worth mentioning that it is a very successful undertaking, which generated important financial results.

Due to the precautionary measure, the company offered sufficient guarantees to cover any possible conviction in this process, which were accepted in 2016 by the MPF and are fully valid and regular.

Even though the works on the São Roque hydroelectric plant are still in the process of being concluded, it is important to clarify that the company São Roque Energética SA is in no way related to the facts mentioned above. The Nova Participações Group reiterates its full confidence in the Judiciary and awaits the review of the decision after submitting the clarifications.”
