Since it entered into force in the labor reform in 2017, the intermittent work contract regime has been causing insecurity among professionals throughout Brazil. Understand how it is applied in practice

O intermittent contract regime or intermittent work, came to Brazil in the labor reform of Nov/2017. The company signs the professional card as intermittent and the employee is paid for hours or days worked. This method is widely used by companies that perform maintenance shutdowns, mainly in the oil sector.

Advantages for companies

For the employer, it is that he can make use of this modality for periods of 'peaks'. Restaurant owners, for example, who have their biggest movements on weekends. For both sides, this intermittent contract made negotiation freer and, consequently, fairer. The employer has up to 2 days to summon the employee to work, who in turn may or may not accept the service according to their availability.

Advantages for the employee

Have you ever stopped to think that the work contract intermittent be the gateway to your return to the job market? O intermittent contract came with everything to stay.

Linliana Gurgel, HR Coordinator, recalls that in Sep/18 he called a candidate offering a job, he did not accept it because it was an intermittent contract. Today some professionals hired in the intermittent format were transferred to fixed contracts (of course this will depend on a need). But that same candidate sent her a message that he still hasn't been reinstated.

For those who work embedded 14 x 14, is it good?

Yes and no! The rights are the same: additional boarding (on notice and danger), 13th. and proportional vacations, day off for each boarding day and so on. What differentiates is that, if you don't have service, you won't receive anything either.
