Currently, the law establishes that the service will only be authorized by municipalities for drivers with a National Driver's License (CNH) type B or higher, that is, those who can drive four-wheeled vehicles.
The Bill extends the possibility of authorization to people with Type A driver's license, which allows driving two or three-wheeled motorized vehicles such as motorcycles, scooters, tricycles and mopeds, bringing about the regularization of motorcycle taxis.

For the author of the new Law, Deputy Amon Mandel (Cidadania-AM), although the law has already been changed to include new forms of transport, such as Uber, the final text led to the exclusion of the motorcyclists category due to a mistake in the wording.
According to the parliamentarian, such limitation, which requires new rules for motorcycle taxis, imposes obstacles not only for drivers who have National driving license in category A who aim to provide passenger transport services through motorcycle apps, but also to potential users of the service, who find it to be a lower-cost alternative for transportation.
The Bill, which will bring about the regularization of motorcycle taxis, will be analyzed by the Urban Development, Roads and Transport, and Constitution and Justice and Citizenship committees.
What are the current rules for motorcycle taxis?
Today, the topic of motorcycle taxis is controversial. São Paulo (SP), for example, is one of the cities where this type of transportation is prohibited. There is no federal rule on the matter and the subject is prohibited or permitted individually by each city government.
Since 2017, there have been bills to bring about the regulation of motorcycle taxis, but a national consensus has never been reached. Only in 2022 did the National Traffic Council (Contran) impose requirements for the practice in cities where it is permitted.
It is now required that drivers be at least 21 years old and have held a category A driver's license for at least 2 years to perform motorcycle courier or motorcycle taxi duties. They are also required to pass a “specialized course, as regulated by Contran”. Finally, the professional must wear a vest with retroreflective elements.
A helmet with a visor or protective glasses specifically designed for motorcycles are required for both the driver and the passenger. As for motorcycles, the vehicle must still have the infamous “red plate”, indicating that it is registered as a rental vehicle. In addition, they must have an engine or leg protector in case of a fall, popularly known as a “dog killer” and a line-trimmer antenna, or kite cutter.
Manaus advances in new rules for motorcycle taxis
The Manaus City Hall, represented by the CEO of the Municipal Institute of Urban Mobility (IMMU), received, on the morning of this Monday (21/10), at the Executive headquarters, representatives and leaders of the app-based motorcycling sector.
The main objective of the meeting was to align demands, strengthen the organization of the category and pave the way for the preparation of a Bill that brings more security, rights and duties to workers in the area.
