PPSA and Petrobras must calculate the compensation to be paid to the oil company for these contributions already made in Sépia and Atapu, in the Santos Basin.

It was established this Wednesday, 29, by the government that the state-owned company Pré-Sal Petróleo SA (PPSA) should represent the Union in negotiations with Petrobras to establish the amount of compensation to be paid to the company for investments already made in the Sépia areas. and Atapu, in the pre-salt layer, after the future auction under the Asset Production Sharing regime.

On November 6 last year, investors in the Transfer of Rights Surplus Bidding Round were offered surplus volumes of oil from the Sépia and Atapu areas, but did not receive proposals and therefore should be re-bid by the Brazilian government.

In addition to Petrobras itself, the auction attracted only small shares of Chinese companies, which at the time was seen as frustrating by analysts.

According to the ordinance published in the Official Journal of the Union this Wednesday, it was defined by the Ministry of Mines and Energy that PPSA and Petrobras “shall calculate the compensation to be paid” to the oil company for these contributions already made in Sépia and Atapu ”.

The state-owned companies must also reach an agreement regarding the participation of the Union and the transferee in these areas.

The proportion between the volume exceeding that contracted in onerous assignment and the recoverable volume in hydrocarbons of the areas that will be auctioned will be used to calculate these shares.

Petrobras and PPSA should meet in person every 30 days together with representatives of the portfolio and the National Petroleum, Natural Gas and Biofuels Agency (ANP) “to report on the evolution of the negotiations” and present studies associated with the discussions.

The oil companies must also agree on a work plan for defining the values ​​of the shares and compensation, in which data and information necessary for the calculation will be specified, in addition to the schedule for the activities.

Petrobras and PPSA will also carry out studies to define the development strategy for the areas after the auction.

The government has been working to carry out a new auction for the Atapu and Sépia areas, but the auction will probably be held for next year.
