In June last year, the TST granted the employees a favorable decision in an action that could have an impact of BRL 17 billion
The Federal Supreme Court has been the scene of important victories for the state-owned company lately. The most recent was made official this Friday, June 21, where Minister Alexandre de Moraes ordered the suspension of a lawsuit against Petrobras at the Superior Labor Court.
The action corresponds to the payment of a salary amount to Petrobras employees, in response to an appeal filed by the oil company's defense in a decision published in the Diário de Justiça this Friday.

The issue stems from a labor claim filed by an oil tanker seeking the payment of salary differences resulting from the calculation of the RMNR.
The decision is yet another outcome of the case in which the TST, in June last year, gave the employees a favorable decision in a labor dispute that could have an impact of R$ 17 billion for the company.
The background is whether or not Petrobras has to make a financial supplement to state employees in a wage type that it already paid, the so-called Minimum Remuneration of Level and Regime (RMNR). The state disagrees.
After the TST's decision, the president of the STF, Dias Toffoli, and Alexandre de Moraes issued injunctions to suspend the effects of the previous conviction and bar the execution of this cause.
In 2018, the state-owned company estimated that the case affects 51 Petrobras employees, in 47 collective actions and more than 7.000 individual actions. The allegation of the two Supreme Court Justices is that, due to constitutional matters involved, the final word has to be from the Supreme Court.
However, Petrobras' defense went again to the Supreme Court, in another type of appeal, because the TST, when analyzing a specific case, "completely ignored" the determination to suspend the progress of actions at the national level.
In practice, this could lead to a future execution against Petrobras, even with the issue not finally being resolved by the Supreme Court.
In his decision, Alexandre de Moraes determined the suspension of this TST process until the Supreme Court gives the final word on the matter. He also cited other cases in which the Supreme decided in this sense to suspend TST decisions.
