Also defendants in the action, which aims to ensure compliance with socio-environmental obligations, are the State Institute for the Environment (Inea) and the State of Rio de Janeiro, said the MPF.

In the action filed by the MPF, it requests a reduction in the release of effluents and the adequacy of the productive activity within 30 days, in addition to requesting the adoption of an emergency plan for the fulfillment of several actions that the company should have adopted in the term of adjustment of conduct (TAC) signed with the Government in 2011.

The TAC ended in 2017 without complying with measures that would be fundamental, in the MPF's view, for effective protection of the environment.

According to the MPF, the company's signing of agreements with INEA and the State of Rio de Janeiro has served to postpone the fulfillment of obligations by the company.

“It turns out that the indefinite postponement of the fulfillment of essential obligations ends up legitimizing the violation, on a large scale, of environmental constitutional principles and all related legislation”, says the Public Prosecutor Julio José Araujo Junior, in a note this Thursday. fair, 19.

Petrobras must repair the damage caused to the environment and the health of the population, through investments in socio-environmental projects in the amount of R$ 50 million, to be established together with the local population, with mandatory participation of the MPF.

Already INEA and the State must repair the damages caused by the omission in the inspection, through the contribution of resources for the implementation of projects destined to the health treatment of the affected population. In addition, the three defendants must repair the collective moral damages caused to the population, together with INEA and the State of Rio de Janeiro. In the amount of BRL 40 million.

The agency's investigation pointed to the existence of problems in the licensing of the refinery and constant dumping of toxic substances in Guanabara Bay and its adjacent water bodies, with strong impacts on local biodiversity.
