The 'taxation of the sun' can be postponed by the Chamber of Deputies, new PL plans to extend the final deadline for the installation of solar energy systems by six months.

The Chamber of Deputies is giving an opportunity to those who plan to generate their own energy through grid-connected solar energy systems. the beginning of the call “taxation of the sun” can be postponed for six months. The charging of distribution costs for those who generate their own solar energy is still expected to start on January 7 next year.

The deadline is determined by Distributed Generation Legal Framework, a law sanctioned by President Jair Bolsonaro this year. However, a substitute approved this Tuesday (6th) in the Chamber of Deputies extends the final deadline for the installation of microgenerators and mini solar energy generators with exemption from charging for the use of the distribution network.

The proposal now needs to go through the Senate before going to the presidential signature. Thus, for those who adopt solar energy at home before the Taxation of the Sun comes into force, the exemption will be maintained until 2045. The text approved by the Chamber of Deputies is a substitute presented by the rapporteur, Deputy Beto Pereira, from the PSDB-MS , to PL 2703/22, of authored by Deputy Celso Russomanno (Republicanos-SP).

Thus, the exemption for small solar energy generation units was extended to new small hydroelectric power plants (PCH). Plants with a generation capacity of 30 MW and authorization granted as of the entry into force of the law approved this week will be considered.

However, the SHPs will have a longer term compared to solar energy generating units. Keeping the wording of the project approved by the Chamber, the mini and micro solar energy generators will have until July next year to file the request with the distributor and the PCHs until July 2024.

Use of solar energy and the reduction in the energy bill

If the PL approved by the Chamber prevails and the start of taxation on the sun is even postponed to July of next year, those who are still thinking about the idea of ​​using solar energy at home will have a little more time to think and evaluate whether their own generation it is more advantageous.

It is important to emphasize that the use of solar energy will most likely remain very advantageous for many companies and people even after the PL for solar taxation comes into force.

In addition, in the long term, the estimate is that the cost of solar panels dim according to the advancement of technology, which should compensate for the increase in the cost of distribution.

A own generation of solar energy is currently exempt from part of the solar energy tariff referring to distribution costs, although generators use the network to inject the remaining energy, generating credits that can be deducted from the electricity bill, in the case of companies and homes, or even sold, in the case of solar energy farms.

Distributed Generation Legal Framework

O Distributed Generation Legal Framework establishes, among a series of other rules, that the mentioned cost is previously charged to the generators, which practically reduces the financial savings of the use of solar energy, although it does not eliminate it.

In addition, the law establishes that all installations of solar generation systems made before the entry into force of the sun tax remain under the current rules, thus, exempt from the charge until 2045.
