A new traffic fine will come into effect this week, more precisely next Wednesday (24), which will cost the offending driver a penalty of more than R$1.400.

According to detran, this measure was defined by the agency in 2023 with the aim of reinforcing safety on Brazilian roads and roads.

Also according to the agency, traffic fines are one of the tools that aim to guarantee safety on the roads, regulating drivers' behavior and, consequently, punishing drivers who commit an infraction.

What is the new traffic fine?

This new fine dealt with in the matter of Click Oil and Gas, which comes into force on the 24th, will be intended to penalize drivers who are caught driving cargo, trailer or passenger vehicles with a toxicological test that was more than 30 days old.

According to the legislation, the infraction in question is considered very serious, with the penalty being set at R$ 1.467,35. However, anyone who thinks that the offender will only be penalized financially is mistaken. This is because, in addition to the value, the caught driver will also add seven points on the National Driving License (CNH).

The purpose of this new penalty

According to information from Detran, this new penalty is intended to increase traffic safety, as drug testing is mandatory for professional drivers. This exam checks the presence of psychoactive substances in the driver's body, such as alcohol, illicit drugs and controlled medications.

According to Detran, this concern comes in the wake of a survey carried out by the Ministry of Health, which found that the use of drugs and alcohol is one of the main risk factors for traffic accidents in Brazil – according to the department, the use of these Substances are responsible for around 20% of accidents, that is, a fifth of the tragedies recorded on Brazilian roads.

Understand how to take a toxicology test

You can already see that taking the exam will be extremely important, as it will avoid a heavy traffic fine and also the addition of points on your driver's license. In this sense, it is important to highlight that drivers interested in taking the test and not running the risk of being penalized should look for a clinic accredited by the National Traffic Department (Denatran).

According to the information, the biological material used for the exam can be urine or hair, and the test results will be available within 15 working days. Today, the law establishes that the frequency with which drug testing must be carried out varies according to the driver's age.

In this sense, for drivers between 50 and 70 years old, the exam must be carried out every five years. On the other hand, for drivers over 70 years of age, the period is reduced to three years.

I got the fine. Can I appeal?

Therefore, upon receiving a traffic fine, the offender must identify the traffic agency that issued the fine, check the deadline for submitting the appeal and:

  • Prepare a reasoned appeal, explaining the reasons why you consider the fine to be unfair;
  • Submit the appeal to the competent body within the established deadline;
  • And, finally, wait for the analysis and result of the appeal.
