When rent payment is late, many landlords feel uncertain about the next steps. The Brazilian legislation provides a clear pathway because the Tenancy Law (Law 8.245/91) allows for eviction action due to non-payment.

This measure ensures that the property owner can reclaim possession through legal means, respecting all legal procedures.

Mandatory Notification Before The Process

The first step is not to go to court. Before that, the landlord needs to formally notify the tenant of the default.

This notification should be recorded and preferably made through a notary public or a letter with acknowledgment of receipt.

The document establishes a deadline for the tenant to settle the outstanding amounts or vacate the property. Therefore, without this step, the eviction process cannot be initiated validly.

Risks Of Illegal Actions

Some landlords try to resolve the situation on their own, but this can lead to serious problems.

Actions such as cutting off water or electricity, changing locks, or preventing the resident from accessing the property are illegal practices.

Furthermore, such actions expose the property owner to lawsuits and even claims for damages. The safest course is always to comply with what the law dictates.

How The Eviction Process Works

If the tenant does not rectify the situation after the notification, the landlord can file for eviction. The process requires documents that prove the debt and the attempt at formal communication.

This request may include a preliminary injunction. This measure, when accepted, allows for eviction within up to 15 days, provided the landlord deposits a bond equivalent to three months’ rent.

However, if the injunction is not granted, the judge decides the case after the normal progression of the process.

In this situation, the tenant will have up to 30 days to voluntarily vacate the property, according to the court’s determination.

Following the correct procedures is essential because it prevents greater wear and costs. The Tenancy Law aims to balance rights, providing the landlord with protection mechanisms without compromising the dignity of the tenant.

Thus, eviction due to non-payment should be viewed as the most appropriate legal solution.

Tive um prejuízo enorme porque nao houve a liberação do juiz para o pedido de despejo, nem da liminar. Minha casa foi destruída, agua, iptu e luz sem pagar, um verdadeiro caos. Uma sujeira sem cabimento. Um prejuizo gigante. Depois de 01 ano ainda estou aguardando a resposta da justiça.

Se a justiça funcionasse na prática, conforme a doutrina e as normas processuais, com prazos legais sendo cumpridos, conforme estudei no curso de Direito na PUC/MG, sem a leniência de juízes, o que acaba resultando em morosidade inadmissível, em prejuízo do proprietário e em favor do locatário inadimplente, talvez eu aceitasse a matéria como correta. É necessário no Brasil deixar de tentar tapar o sol com peneira.
