A driver was surprised with a fine of US$ 116, equivalent to about R$ 575, during a traffic stop in Florida, United States, in recent weeks.

The penalty was applied for allegedly using a cell phone while driving, according to a police officer who claimed to have seen the driver holding the device with their right hand.

The incident took place on a public road, gained traction on social media, and drew attention because the accusation describes a physically impossible infraction: the driver does not have a right arm.

Shortly after the citation, the driver recorded a video to explain the situation. With a calm demeanor, she questioned the officer about what he observed during the trip.

She then raises her arm and reveals it is amputated below the elbow, directly contradicting the description on the fine recorded in the notification.

Viral Video Exposes Enforcement Error

The recording was initially posted on TikTok and quickly amassed millions of views.

Although the video was later removed, the content had already spread, sparking debates about failures in enforcement and possible automatic approaches without proper fact-checking.

In addition to the clear observational error, the episode raised questions about the correct application of the law. Many users pointed out that the mere allegation of using a cell phone does not always constitute an infraction.

Traffic Law Does Not Punish Only “Holding A Cell Phone”

In Florida, the legislation stipulates that an infraction occurs when the driver is typing, sending messages, or entering information on the cell phone. In other words, merely holding the device is not sufficient to constitute the penalty.

Thus, even if there were no physical impossibility, the applied fine could already be questioned due to misinterpretation of the regulation.

Appeal Should Lead To Annulment Of Fine

Given the technical error and legal inconsistency, the driver indicated that she intends to appeal to the courts.

Experts believe that the case has a strong chance of resulting in the dismissal of the fine, reinforcing the importance of precise approaches and correct understanding of traffic law.
