ANP Approves Offering Pre-Salt Blocks for Auction

ANP (National Agency of Petroleum) Approves Notice That Verifies Permanent Offering of Pre-Salt Blocks for Auction

The ANP board approved this Friday, April 29, 2022, the notice and contract models for the Permanent Production Sharing Offering (OPP). In this notice, the scheduled date for the auction is at the end of this year, 2022, and it provides for negotiations of 11 blocks located in the pre-salt polygon.
The mentioned notice has already undergone public consultation and hearings, and the procedures have been submitted for approval from the MME (Ministry of Mines and Energy), and will then be submitted for consultation with the TCU (Court of Accounts of the Union).

According to the website Petronotícias, initially the Permanent Offering was in the form of a bidding process aimed at the concession contract regime, however this offering did not allow for the inclusion of pre-salt areas. However, this changed following the publication of a resolution by the CNPE (National Council of Energy Policy) that established the rule that fields or blocks in the pre-salt area or in underlying areas could be auctioned under the Permanent Offering system.
The blocks Ágata, Água Marinha, Esmeralda, Jade, Turmalina, and Tupinambá are the blocks that will be auctioned through the notice approved by ANP. These were scheduled to be offered in the 7th and 8th production sharing rounds in the Santos Basin. In addition to the blocks mentioned above, blocks that were not offered in bidding rounds for sharing will also be auctioned. These are the Itaimbezinho, Norte de Brava, Bumerangue, Cruzeiro do Sul, and Sudoeste de Sagitário blocks, belonging to the following rounds: 4th Sharing Round, Campos Basin, 6th Sharing Round, Campos Basin, 6th Sharing Round, Santos Basin.

OPP and OP Use Different Techniques for Data Transparency to Clients

Unlike oil auctions, which use the 17th Concession Round, 6th Sharing Round – for example – the Permanent Offering regime allows registered companies access to technical data of areas in which they have expressed interest. This occurs without a predetermined deadline by a notice, and the areas remain continuously available.
On the other hand, the Permanent Production Sharing Offering combines the bidding model with the production sharing regime. This union grants a share of the oil and gas produced in the fields. In the described regime, Petrobras has the right of preference, where the company indicates the percentage of contribution in the consortium that will hold the contracts. With that said, Petrobras declared preference for the pre-salt blocks Água Marinha and Norte de Brava, where it will have a 30% stake in the blocks.

ANP Negotiates 59 Pre-Salt Blocks

On Wednesday, April 13, 2022, ANP concluded the 3rd cycle of the Permanent Offering that negotiated 59 exploratory pre-salt blocks, raising about R$ 422 million in signing bonuses. The result of the offering was satisfactory, as the OP model was used. Other factors were also quite beneficial, such as, in terms of revenue for the Treasury, the bonuses and the areas auctioned. Comparing with previous years, the 1st Cycle of the Permanent Offering in 2019 raised R$ 15.3 million and negotiated 33 assets, while the 2nd Cycle in 2020 raised R$ 30.9 million in bonuses and sold 17 concessions. The premium in this context was approximately 854%, and in total, 13 different companies won areas in the auction.

International Companies Lead Auction of Pre-Salt Blocks

The international companies TotalEnergies, Shell (represented by its consortium), and Ecopetrol were the protagonists of the auction that took place between 2019 and 2020, in a dispute for pre-salt blocks located in the waters of the Santos Basin.

Also noteworthy were the companies Petro-Victory and Origem Energia, which stood out as the companies that won the most blocks, all located onshore. The company Origem bought a total of 18 blocks, focusing on the Sergipe-Alagoas Basin, where the Alagoas Polo, an asset purchased by the company from Petrobras for about US$ 300 million, is located. Meanwhile, Petro-Victory secured 19 pre-salt blocks.
