Brazilians with debts were caught off guard by a recent decision from the Superior Court of Justice (STJ), which puts millions of people at risk who were previously confident that their financial issues had expired after five years. Now, even with the expiration of the debt, the name remains on Serasa. This change brings new challenges for those trying to recover credit in the market.

With over 62.5 million people having bad credit in Brazil, this decision directly affects a significant portion of the population, especially those who relied on the “expiration” of the debt after five years. But what exactly has changed?

Name on Serasa Even With Expired Debt: What Does This Mean?

Until now, the rule was clear: after five years, the debt expired, and the debtor’s name was removed from default registries like Serasa. This removal was also important for calculating the Score, an index used by financial institutions to assess consumer credit.

With the new decision, the debt remains expired, meaning the creditor can no longer legally pursue the debtor. However, the STJ determined that the debtor’s name will not be completely removed from Serasa’s registry, but rather from areas like Serasa Limpa Nome, which may continue to hinder access to credit for millions of Brazilians with debts.

STJ Decision: Understanding the Case

The case that led to the decision involved a debtor with an expired debt, who requested the removal of their name from the Serasa Limpa Nome registry. They took legal action asking for the debt to be considered unenforceable and for their name to be removed from any list of debtors. However, the STJ denied the request.

The justification was that, although the debt has expired and can no longer be legally pursued, it still exists at its source, and the debtor’s name remains in the registry, potentially impacting their financial history.

How to Clear Your Name on Serasa?

Cadê a Lei? Pelo que eu saiba tem que ser legislado, aprovado pela Câmara de deputados, deliberado pelo Senado, sancionado e assinado pelo atual presidente, após ser divulgado no diário Oficial. Só a decisão do STJ, não é válido para todos. É um fato isolado. Pelo que entendo, o STJ não tem competência para legislar.
Além do mais, nem todos com restrição no CPF, são individuais. Sofri um golpe no cartão de crédito, fui roubada no valor de mais ou menos R$4.000,00. No dua 08/07/2021, quando percebi o golpe, entrei no SAC da CEF, bloqueie o cartão dd crédito e acresenttei não reconhecer 3 dividas realizadas pelo “vigarista”. A CEF slem sd sustar as três dívidas. Está me cobrando h9je 16.000,00. Quem deve ser penalizado, eu com meu CPF, ou a CEF?.
Irei aguardar os cinco anos, e se, está decisão não sd tornar lei. Eu entrarei bontra a CEF. CRIMINALIZANDO esra por não ter realizado o protocolo. E quanto a decisão do STF, no meu entender, abrir precedente para o meu caso, criminalizar a CEF, por acréscimo o SERASA , caso o meu nome não seja baixado da inadimplência.
A SERASA todos os dias, faz ameaças. Cuidado!
Nos brasileiros não estamos tão desinformados assim!. Além do mais, eu nunca devi e não devo nada do que eu compro.

Diante o exposto, solicito que o SERASA, pegue leve nos seus avisos d convites para cobranças. Já está caracterizando ameaças, além de constrangimento a quem tem restrição no CPF. Não interessa, sd seja põe haver sofrido GOLPE de vigarista, meu caso. Seja por que, a pessoa está indivudado mesmo.
