Proposal Establishes Clear Criteria for Commercialization, Limits Capacity to 50 ml, and Sets Penalties That Can Reach Up to 10 Minimum Wages in Case of Misuse
The Chamber of Deputies approved on Wednesday (11) a bill that authorizes the commercialization, purchase, and possession of aerosol plant extracts, such as pepper spray, for women over 16 years old as a personal defense measure. The proposal, authored by Congresswoman Gorete Pereira (MDB-CE), now goes for Senate review.
The information was disclosed by the legislative coverage of the Chamber, which detailed the rules established by the approved text. According to the proposal, the spray may be used exclusively to repel “unjust, current, or imminent” aggression, always proportionately and moderately. Furthermore, the text stipulates that the use must be halted immediately after the threat has been neutralized.
Rules for Purchase, Authorization, and Control of Pepper Spray

Although the bill authorizes access to the product, it imposes strict criteria for acquisition. Women between 16 and 18 years old will need to present authorization from a legal guardian to purchase the pepper spray. At the time of purchase, the presentation of the following will be mandatory:

In other words, the proposal establishes a clear legal filter to prevent personal defense equipment from being obtained by individuals with relevant criminal histories.
Additionally, the technical specifications of the product, including the maximum allowed concentration, will be defined by the National Health Surveillance Agency (Anvisa). Therefore, control is not limited to sales but also encompasses technical and regulatory aspects.
Another important point concerns the capacity of the container. Sprays may have a maximum capacity of 50 ml. Containers with greater capacity will remain restricted to use by the Armed Forces and law enforcement.
Penalties and Registration Requirement in Case of Theft or Loss
On the other hand, the misuse of pepper spray may result in significant penalties. If a woman uses the product outside the situations provided for by law, penalties may range from a formal warning to a fine that can reach 1 to 10 minimum wages.
Furthermore, the text stipulates that in case of theft or loss of the spray, the owner must register a Police Report within 72 hours. This requirement aims to prevent irregular use of the equipment by third parties and to reinforce control over the handling of the product.
Therefore, although the bill expands access to pepper spray as a personal defense tool, it also imposes clear mechanisms of responsibility and supervision.
