Still In São Paulo, There Was An Infraction At Another Gas Station That Displayed A Trade Mark Even Though It Was Registered As A White Flag With The ANP And Did Not Inform The Origin Of Gasoline, Diesel, And Ethanol.

Between August 15 and 19, the ANP carried out inspections in the fuel market in ten Federative Units, covering all regions of the country. Among all the gas stations checked by the Agents in different Brazilian states, the one that stood out the most was a gas station in São Paulo, which was fined and completely shut down for selling adulterated gasoline and ethanol!

During the actions, the inspectors checked if the agency’s rules – such as compliance with the fuel quality standards, provision of the correct volume by the pumps, presentation of adequate equipment and documentation, among others – were being followed.

The ANP also verifies if all the information is being provided correctly to the consumer. The agency has been monitoring compliance with Decree No. 11,121/2022, which made it mandatory to display the prices of liquid fuels as of June 22, 2022, in addition to the current price, which is already required to be displayed on its panels. In some locations, the ANP has been working together with consumer protection agencies, through agreements or partnerships. 

The agency also carries out other actions in partnership with various public agencies, in joint operations or task forces.

The segments of gas stations; LPG resellers; ethanol, biodiesel, and lubricant producers; lubricant resellers; transporters-resellers-retailers (TRRs); used lubricant oil collectors; rerefiners and aviation fuel resellers in the states:

Amazonas 

The inspectors were in Tabatinga to check the operation of an aviation fuel reseller, three gas stations, and eight LPG resellers.  

Three LPG resellers were fined for irregularities such as price panel discrepancies with the legislation and for not having scales for weighing the cylinders, which can be requested by consumers. 

Santa Catarina 

The inspection actions were concentrated in the city of Blumenau, where 14 gas stations were inspected. One of the establishments in the municipality was fined for not having the necessary equipment for fuel analysis, a procedure that can be requested by consumers.  

Rio Grande do Sul 

In the state, the inspection took place at 15 gas stations in the cities of São José do Norte and Pelotas, where the ANP participated in a joint action with the Municipal Procon and the National Institute of Metrology, Quality, and Technology (Inmetro) on the 16th and 17th. No irregularities were found. 

Paraná 

The inspection actions took place in the cities of Curitiba and Fazenda Rio Grande, totaling 11 inspected gas stations. 

In the capital, one station was fined for not operating during the minimum hours required by law. 

São Paulo 

The ANP inspectors checked the operation of 31 economic agents, including gas stations, producers and resellers of lubricants, used lubricant oil collectors, and rerefiners. The inspection actions took place in the municipalities of Aguaí, Araçatuba, Boituva, Glicério, Iperó, Itu, Penápolis, São Paulo, and Sorocaba. 

A finished lubricant oil producer from Itu was fined and shut down for operating without the agency’s authorization, having 93,476 liters of base lubricant oil seized. The operation was supported by the ANP’s Center for Research and Technological Analysis (CPT). 

In São Paulo, a gas station was fined and completely shut down (20 nozzles and four tanks) due to a series of irregularities: selling common gasoline outside specification, containing 52% anhydrous ethanol (the law requires 27%); selling additive gasoline outside specification, containing 50% anhydrous ethanol (the law requires 27%); selling hydrated ethanol outside specification regarding alcoholic content (99.5º INPM, while the law specifies between 92.5º and 95.4º INPM) and concerning methanol content (above 0.5%). 

Another station in the capital was fined for not having all the equipment for fuel quality testing; not having a thermohydrometer (a device used to check ethanol quality aspects) properly attached to the hydrated ethanol pump; not properly informing the origin of the fuel sold; and for not having updated records of equipment and tanks. 

Still in São Paulo, there was an infraction at a station that displayed a trade mark even though it was registered as a white flag with the ANP, in addition to not properly informing the origin of the fuel sold. Two other stations were fined for not having all the equipment for fuel quality testing, a procedure that can be requested by consumers. 

Goiás 

The ANP inspectors were in the cities of Aparecida de Goiânia, Goiânia, Goiatuba, Ipameri, Itumbiara, and Morrinhos. In total, 15 gas stations, two LPG resellers (one unauthorized), six ethanol producers, one biodiesel producer, and two transporters-resellers-retailers (TRRs) were inspected. 

In Aparecida de Goiânia, a LPG reseller that had no authorization from the agency to operate was fined, shut down, and had 15 cylinders seized. In Goiatuba, one station was fined for not having all the equipment used in fuel quality analysis, a procedure that can be requested by consumers. 

Three gas stations in Goiânia were also fined for not having all the equipment used in fuel quality analysis. Two other stations in the municipality were fined for malfunctioning thermohydrometers (a device used to check the quality aspects of ethanol) attached to the hydrated ethanol dispensing pumps. 

Minas Gerais 

The ANP inspected 16 regulated agents in the field, in the municipalities of Belo Horizonte, Sete Lagoas, and Lagoa Santa. Inspections included gas stations and LPG resellers.  

The inspectors are continuing their work of verifying and collecting the selling prices for liquid fuels, as well as checking the implementation of the price framework required by Decree No. 11,121, dated July 6, 2022.  

In Sete Lagoas, one gas station was fined for not presenting the instruments for fuel quality analysis, which are mandatory as consumers may request these tests.  

In Belo Horizonte, the seizure and collection of automotive lubricants sold without registration with the ANP occurred in a gas station.

Pernambuco 

Jaboatão dos Guararapes, Nazaré da Mata, and Recife were the cities visited by the ANP inspectors during this period. In total, they checked the operation of 10 gas stations. 

One gas station in each municipality was fined for the same reason: not having the instruments used for fuel quality analysis, a test that can be requested by consumers. 

Ceará 

Fourteen gas stations and one LPG reseller were inspected in the city of Iguatu. Six stations were fined by the ANP for irregularities such as the absence of instruments for fuel quality analysis, non-compliance with safety regulations, presenting a price panel that is inconsistent with the legislation, and problems with the thermohydrometer (a device attached to ethanol pumps to check quality aspects), among others. 

Rio de Janeiro 

In Rio, the ANP coordinated a task force focused on the inspection of natural gas vehicle (GNV) refueling. The operation took place in the capital and in Teresópolis, in the Serra region. 

In addition to the agency, participants included Ipem/Inmetro, Detro-RJ, Military Police, Municipal Transport Secretariat (SMTR), Operation Foco (linked to the State Government’s Civil House), and Procon-RJ. Each agency acted within its legal responsibilities.  

The ANP did not find irregularities in the 11 economic agents it inspected. The inspectors checked if GNV refueling was respecting the maximum pressure limit, which is 220 bar. The agency also observed other items, such as the quality of liquid fuels and guidelines on good practices in the GNV market.   

Check The Results Of The ANP Actions Throughout Brazil

According to the ANP, the agency’s inspection actions are planned based on various intelligence vectors, such as consumer complaints, data from the Agency’s Fuel Quality Monitoring Program (PMQC), information from other agencies, and the ANP’s Intelligence area, among others. Thus, the actions are focused on regions and economic agents with indications of irregularities. 

To track all of the ANP’s inspection actions, access the Dynamic Panel for Refueling Inspection. The database is updated monthly, with a two-month gap between the month of inspection and the publication month, due to compliance with legal requirements and operational aspects.

Establishments fined by the ANP are subject to fines ranging from R$ 5,000 to R$ 5 million. Sanctions are applied only after an administrative process, during which the economic agent has the right to a broad defense and contradictory, as defined by law.
