The Laginha Bankruptcy has returned to the center of attention of the Judiciary after the CNJ decision that suspended the payment of R$ 331.5 million to heirs and lawyers connected to the estate of João Lyra.

The measure was recently taken by the national Justice corregedor, Mauro Campbell Marques, in Brazil, with the aim of avoiding risks to the bankruptcy estate.

The case, which has dragged on for 18 years and involves about 19,000 creditors, may now evolve into a STF dispute, should the decision be challenged.

Additionally, the suspension occurred amid concerns regarding the order of payment to creditors and possible irregularities in the calculations.

For this reason, the CNJ also mandated a detailed audit of the process.

Laginha Bankruptcy: CNJ Decision Generates New Judicial Crisis

The recent CNJ decision provoked a strong reaction behind the scenes of the Judiciary.

This is because the blockage of amounts considered significant reignited tensions among lawyers, heirs, and judicial authorities.

According to Mauro Campbell’s justification, the measure seeks to preserve the integrity of the bankruptcy estate.

He highlighted the risk of compromising payments to preferred creditors, such as workers and financial institutions.

On the other hand, the decision was not received unanimously. Some experts consider the CNJ’s intervention unusual in this type of process.

In addition, the dispute includes thousands of creditors, increasing the pressure for a definitive solution.

In this context, any judicial decision has a direct impact on the payment order and the recovery of owed amounts. 

Laginha Bankruptcy Accumulates Controversies And Disputes Over The Years

Since the declaration of bankruptcy in 2014, the case has been marked by controversies.

Among the main points are allegations of favoritism, the removal of judges, and conflicts among heirs.

Meanwhile, attempts to resolve the situation have progressed slowly.

In December 2024, for example, the majority of creditors approved a payment plan.

This plan included the Union and the state of Alagoas.

However, its execution still faces significant legal challenges.

Founded in 1958, Laginha was one of the largest groups in the sugar-energy sector in Brazil.

With operations in Alagoas and Minas Gerais, the company was economically significant for decades.

However, the scenario changed in 2008 when the company entered judicial recovery due to high indebtedness.

Since then, the process has remained unresolved, becoming one of the most emblematic cases in the Brazilian Judiciary. 

CNJ Decision May Redefine The Course Of The Laginha Bankruptcy

The current CNJ decision may be decisive for the future of the case.

This is because the suspension of payments and the audit may alter the order of priority among creditors.

In addition, the possible advancement to a STF dispute tends to further increase the complexity of the process.

The outcome will depend on the next judicial decisions and the analysis by the CNJ plenary.

Thus, the Laginha Bankruptcy remains one of the most sensitive and closely followed processes in the country, involving billions of reais and thousands of interested parties.
