The Federal Court of Accounts Set a Deadline for Petrobras to Detail Its Pricing Policy, Highlighting Audit Points on Transparency and Control.

Petrobras is under the radar of the Federal Court of Accounts (TCU) to account for its fuel pricing policy.

The decision, announced by the Court, gives the state-owned company a deadline of 120 days to clarify critical points of its commercial strategy, which in the last year has dissociated itself from the Import Parity Price (IPP).

The measure, which directly affects consumers and the fuel market, places the company in a position to explain in detail how it is structuring its prices and commercial decisions.

Audit Demands and Extension of Analysis for Two Years

According to the TCU, an initial audit raised some questions still lacking clear answers regarding Petrobras’ pricing policy.

In response, the Court extended the investigation into the state-owned company’s commercial practices for an additional two years to closely monitor its actions.

The measure is seen as an attempt to ensure that the company complies with the laws regulating state-owned companies and ensures a pricing policy that is transparent and aligned with the country’s interests.

What Is at Stake in the TCU’s Request?

Although the TCU did not point to illegalities in Petrobras’ compliance with the laws governing it, the audit revealed gaps in transparency and the adequacy of some internal procedures.

Aroldo Cedraz, the reporting minister of the case, stated that while some points of Petrobras’ strategy seem aligned with legal requirements, others still lack greater detail to ensure full compliance with governance standards and the standardization of the state-owned company.

According to the minister, it is essential for Petrobras to clarify and formalize its practices to ensure the trust of consumers and the market.

Audit Seeks to Clarify Crucial Points

To deepen the analysis, AudPetróleo – a unit specialized in audits of oil, natural gas, and mining – has drawn up a list of seven questions for Petrobras, addressing different aspects of the pricing policy.

Among the demands are:

  • Alignment of the pricing policy with the laws that regulate Petrobras as a state-owned company;
  • Compliance of the strategy with the company’s general guidance;
  • Suitability of the pricing policy to the standardization rules of internal processes;
  • Completeness of the guidelines and criteria that define the pricing strategy;
  • Existence of detailed norms for the execution of the policy;
  • Implementation of the strategy since its adoption;
  • Monitoring of the execution by the board of directors and administrative council.

These points aim to verify whether the policy adopted during the management of former president Jean Paul Prates, when it was dissociated from the IPP, is being implemented clearly and structured for the company’s managers.

Central Issues: Detailing and Clarity for Managers

Among the seven items listed by the audit, the fourth and fifth points are the most critical. In particular, the lack of formal norms to detail the execution of the pricing policy raises concerns for the TCU.

This aspect is considered crucial for directors and employees to understand the strategy and thus be able to apply it appropriately.

The absence of these internal norms creates doubts about the clarity and consistency of the adopted policy, opening up space for divergent interpretations and potential operational problems.

To meet the Court’s request, Petrobras will need to formulate, within the stipulated period of 120 days, these internal norms and present detailed responses to each of the raised questions.

The goal is to ensure that the technical and administrative body of the state-owned company has a full understanding and tools to monitor the application of the company’s commercial strategy.

Commitment to a National Pricing Policy

The policy of dissociating from the IPP adopted by Petrobras is part of a campaign promise from President Luiz Inácio Lula da Silva, who advocated for “Brazilianizing” fuel prices during his bid for a third term.

This promise was implemented with Jean Paul Prates’ entry into the presidency of Petrobras, aiming to reduce the influence of international prices on the domestic market.

As a result, the strategy aims to make fuel prices more affordable for Brazilian consumers, especially during times of high global volatility in oil prices.
