Launched in September last year, with the aim of expanding the Brazilian railway network with private investment, the Pro Trilhos program begins this year with 21 authorization contracts for the construction and operation of railways signed. The formalization between the Union and companies that required the creation of their own railways by the new model came out in the DOU.

Together, these undertakings accumulate around 6.839,69 km of new tracks for the national rail network, mainly for the rail networks in the states of Minas Gerais, Paraná, Espírito Santo, São Paulo, Maranhão, Santa Catarina, Pernambuco, Bahia, Mato Grosso do Sul , Piauí, Goiás and Mato Grosso, in addition to the Federal District. So far, there are 12 companies that have the proper authorization from the Federal Government to operate, building and operating, with their own resources, railroad terminals and railroads in 13 units of the Federation.

The granting through authorization is a procedure with less bureaucracy and faster than the traditional concession model. Proof of the speed of the new regime of the Pro rails program is that the first proposals with authorizations were filed in September last year with the MInfra.
MInfra receives 76 requests for the construction and operation of railways
Even so, since then, the 21 projects authorized for the Pro rails program have gone through a judicious path. The program included checking the documentation and detailing the proposal by the National Land Transport Secretariat (SNTT) team, analysis by the National Land Transport Agency (SNTT), analysis by the National Land Transport Agency (ANTT) and assessment of the undertaking's compliance with the national public sector and transport policy, again at SNTT.
So far, MInfra has received 76 requests for the construction of railroads through the Pro rails program, totaling 19 kilometers of new private railroads, passing through 16 units of the Federation and with investments reaching R$ 224 billion.
It is estimated that 2,6 million direct and indirect jobs will be created, CO2 emissions and transport costs will be reduced, in addition to updating the Brazilian railway network.
Pro Trilhos Program
The Railway Authorization Program, developed through Provisional Measure 1.065/2021, initiates the grant by authorization for the sector, making the initiative in the railway market free.
Thus, the private sector can create and operate yards, branches, railroad terminals, among others. The Legal Framework for Railways was assessed by the National Congress on December 14 of last year and was sanctioned by President Jair Bolsonaro 10 days later. Therefore, logistics operators and industrial transporters are free to request authorization for railway construction and operation.
