In The 2025 Vacation, Understanding The Calculation Of Your Right, The Deadlines, And The Situations In Which The Company May Be Required To Pay Double Is Essential For Planning Your Rest Without Losing Money Or Being Pressured To Waive Part Of The Period.

Furthermore, many people still have doubts about whether it is worth selling 10 days, how the division into periods works, and how unjustified absences can reduce vacation days. Mastering The Rules Of The 2025 Vacation Is The Best Way To Protect Yourself Against Company Errors And Make Conscious Decisions About Your Own Rest.

The 2025 Vacation Goes Far Beyond Choosing A Trip Or Deciding To Stay Home To Rest. It Involves A Right Provided For In The Constitution And The CLT, With Clear Rules Regarding Acquisition Period, Granting Period, Calculation, Deductions, And Deadlines That The Company Must Respect.

By Understanding How Each Step Works, The Worker Can Verify Whether The Amount Paid Is Correct, Whether There Is A Risk Of Losing Vacation Days Due To Unjustified Absences, Whether There Is A Right To Double Payment, And Whether It Is Really Worth Selling 10 Days Just To Improve The Income Of A Single Month.

Well-Planned 2025 Vacations Mean Real Rest, Protected Wallet And Less Headache With Calculation Errors.

How The Right To Vacation Works In Practice

The Right To The 2025 Vacation Follows The Same Logic As The CLT, Divided Into Two Main Periods:

The First Is The Acquisition Period, Which Is The 12-Month Work Period That You Need To Complete To Have The Right To 30 Days Of Vacation. Only After Completing This Cycle Does The Right To Full Vacation Arise.

The Second Is The Granting Period. After You Acquire The Right, The Company Has Another 12 Months To Grant The Vacation.

If The Company Does Not Grant The Vacation Within This Period, The Law Provides For A Severe Penalty: Double Payment Of The Vacation. This Rule Was Created Precisely To Prevent The Worker From Spending Years Without Adequate Rest.

How To Calculate How Much You Receive During The 2025 Vacation

The Calculation Of The 2025 Vacation Is Simpler Than It Seems When You Understand The Basic Logic. The Gross Amount Of The Vacation Consists Of:

Gross Salary + Additional One-Third Constitutional

This One-Third Additional Is Guaranteed In The Text Of The Federal Constitution And Exists So That The Worker Has More Resources During The Rest Period.

Practical Example:
If The Salary Is R$ 3,000.00:
1/3 Of R$ 3,000.00 Is R$ 1,000.00.
Thus, The Gross Amount Of The Vacation Will Be R$ 3,000.00 + R$ 1,000.00 = R$ 4,000.00.

On This Amount, Deductions For INSS And, Depending On The Bracket, Income Tax Apply. In Other Words, The Net Amount Of The 2025 Vacation Will Be Less Than The Gross, But The Calculation Base Will Always Be The Salary Plus The Additional One-Third.

Another Fundamental Point: The Payment Of The Vacation Must Be Made At Least Two Days Before The Start Of The Rest Period.

If The Company Pays Outside This Period, It Opens Space For Legal Discussion About Double Payment.

Is It Worth Selling 10 Days During The 2025 Vacation?

The CLT Allows The Worker To Sell Up To 10 Days Of Their Vacation. This Is Technically Called Pecuniary Allowance, Provided In Article 143.

In Practice, You Take 20 Days Off And Receive, In Cash, The Equivalent Of 10 Days, With The Additional One-Third Also On Those Sold Days.

From A Financial Perspective, Selling 10 Days During The 2025 Vacation Increases The Amount Received That Month, Which Can Help Organize Bills, Pay Debts, Or Make A Larger One-Time Expense. However, From The Perspective Of Physical And Mental Health, You Lose Part Of The Rest To Which You Are Entitled.

The Choice Should Be Free. The Decision To Sell Vacation Is Up To The Worker, And The Company Cannot Force Anyone To Sell 10 Days.

If There Is Coercion, Pressure, Or Threat Of Dismissal Linked To The Sale Of Vacation, This Behavior May Lead To Legal Discussion And Even Compensation For Moral Damages, Especially In Cases Where The Worker Is Systematically Deprived Of Their Full Rest.

Divide Or Take All At Once: How To Fraction The Vacation

The 2025 Vacation Can Be Divided, Provided The Rules Established In The CLT Are Respected. Legislation Allows The Vacation Period To Be Split Into Up To Three Parts, Following These Conditions:

One Of The Periods Cannot Be Less Than 14 Consecutive Days
The Other Two Periods Cannot Be Less Than 5 Consecutive Days Each

This Splitting Allows Adapting The Vacation To The Reality Of The Worker And The Company, Whether To Organize Trips At Different Times Of The Year, Or To Align With The School Calendar Of Children Or Periods Of Greater Movement At Work.

At The Same Time, Those Who Prefer To Take 30 Consecutive Days Also Have The Right, Provided There Is An Agreement With The Company Regarding The Best Date, As The Final Decision On The Timing Of The Grant Is Up To The Employer, Who Must Notify At Least 30 Days In Advance.

Who Chooses The Date Of The 2025 Vacation?

The Choice Of The Date Of The 2025 Vacation Is Not Totally Free For The Worker. According To The CLT, The Company Decides The Exact Date Of The Vacation, Considering Internal Organization, The Need For Substitutions, And The Business Operation.

On The Other Hand, The Company Must:

  • Notify The Employee At Least 30 Days In Advance
  • Respect The Granting Period Of 12 Months After The Acquisition Period
  • Avoid Abusive Practices, Such As Scheduling Vacation In A Way That Deliberately Harms The Worker

In Practice, Many Companies Negotiate With The Employee And Seek To Reconcile The Interests Of Both, But The Formal Decision Is Up To The Employer.

Unjustified Absences: How They Reduce Vacation Days

Unjustified Absences Have A Direct Impact On The 2025 Vacation. Article 130 Of The CLT Provides A Table For Reducing Vacation Days According To The Number Of Absences Over The Acquisition Period. It Works Like This:

  • Up To 5 Unjustified Absences: The Worker Maintains The Right To 30 Days Of Vacation
  • From 6 To 14 Unjustified Absences: The Right Drops To 24 Days Of Vacation
  • From 15 To 23 Unjustified Absences: The Right Becomes 18 Days Of Vacation
  • From 24 To 32 Unjustified Absences: The Right Decreases To 12 Days Of Vacation
  • Above 32 Unjustified Absences: The Worker Loses The Right To Vacation In That Acquisition Period

This Shows How Important It Is To Justify Absences Formally Whenever There Is A Legitimate Reason.

The Absence Without Justification, In Addition To Salary Deductions, Can Directly Reduce The Rest At The End Of The 12-Month Cycle.

When The Company Must Pay Vacation In Double

The Penalty Of Double Payment Of Vacation Exists To Force Companies To Respect The Granting Deadline. If The Granting Period Of 12 Months Expires Without The Worker Having Enjoyed The Vacation, The Company Becomes Liable For Double Vacation Payment, Including The Constitutional One-Third.

In Addition, There Are Legal Discussions When Payment Is Made Outside The Deadline Of Up To Two Days Before The Start Of The Vacation. In Many Cases, The Labor Court Recognizes The Right To Double Payment When The Company Does Not Respect This Legal Deadline.

Therefore, In The 2025 Vacation, It Is Essential To Check:

  • If The Acquisition Period Has Already Been Completed
  • If The Company Is Within The Granting Period
  • If The Payment Has Been Made Correctly And On Time

Deadlines To Claim And Protect Your Rights

The Rights Related To The 2025 Vacation Cannot Be Claimed Forever. There Are Two Important Limits:

You Can Only Claim In Court The Last 5 Years Of Labor Rights
After Dismissal, You Have Up To 2 Years To File A Labor Lawsuit

This Means That Letting Time Pass Is A Real Risk Of Losing Money. If The Company Did Not Pay Vacation, Paid Incorrectly, Did Not Pay Double When They Should Have, Or Forcibly Sold 10 Days Under Pressure, You Need To Act Within These Deadlines To Avoid Losing Your Right.
