Agreement Seeks to Accelerate Reimbursement of Retirees and Pensioners Who Did Not Recognize Debts in Their Benefits
The Public Defender’s Office will act as the legal representative of retirees and pensioners affected by undue discounts on their INSS benefits. The protocol, signed on September 18, 2025, reinforces access to Justice and creates a safer path for financial reparation.
Legal Instruments and Access to Justice
The president of the INSS, Gilberto Waller Júnior, and the minister of the AGU, Jorge Messias, signed a protocol with the National Council of Public Defenders-General (Condege). Thus, public defenders will be able to establish Technical Cooperation Agreements (ACTs) with the INSS.
These instruments guarantee access to data from insured individuals who contested discounts but do not recognize the alleged authorizations presented by associations. Furthermore, the transfer of information requires express consent from the beneficiary, provided exclusively through the official channels of the agency.

Therefore, the measure strengthens the constitutional right of access to Justice, provided for in Article 5, Item XXXV, of the Federal Constitution, ensuring judicial review of any injury or threat to rights.
Administrative Reimbursement and Its Legal Limits
In July 2025, the federal government initiated the administrative phase of reimbursement. Since then, more than 2.3 million insured individuals have received reimbursements, totaling R$ 1.29 billion reimbursed by September, according to the INSS.
However, victims of the so-called “fraud of the fraud” were not included. In these cases, associations presented false documents as if they were authorizations. As a result, the insured individuals were left out of the initial administrative agreement.
With the participation of the Public Defender’s Office, however, these victims now have free representation, which ensures quicker access to reimbursement and reduces the need for lengthy processes.

Legal Conditions for Joining the Agreement
The reimbursement occurs in full, but requires the waiver of lawsuits against the INSS that involve compensation or double refunds. Nonetheless, beneficiaries retain the right to take legal action against the entities responsible for the discounts, according to the Civil Code and the Consumer Defense Code.
In addition, the amount can be checked via Meu INSS or in person at the Post Office, at no cost and without the need to send documents. However, the Central 135 remains valid only for information and disputes, not for joining the agreement.
According to the INSS, by September, 5.6 million insured individuals declared they had not authorized discounts, while only 124,000 confirmed the debts.
Legal Procedure for Joining via Meu INSS
The administrative process is simple but must be done carefully:
- First, access the Meu INSS app with your CPF and password;
- Then, go to “Check Requests” and click on “Fulfill Requirement”;
- Next, carefully read the last registered comment;
- Then, check “I agree to receive” and confirm by clicking “Send”;
- Finally, wait for the amount to be credited to the already registered account.
This administrative flow, therefore, ensures legal security because all acts are recorded in the official system.
Who Is Entitled to Administrative Reparation
The agreement covers insured individuals who suffered discounts between March 2020 and March 2025. Thus, retirees and pensioners who contested debts and did not receive a response after 15 business days can already join.
Furthermore, payment is made automatically to the same account where the benefit is credited, ensuring effectiveness and transparency.
Alternatives for Those Who Have Not Yet Contested Discounts
Beneficiaries who have not yet contested have two options:
Via Meu INSS:
- First, access the website or app;
- Then, go to “What do you need?” and type “Check Entity Discounts”;
- Next, indicate whether you recognize the debts or not;
- Then, register your phone and email;
- Finally, confirm the information and click on “Send Declarations”.
At the Post Office:
- Retirees can also visit designated agencies and register the request for reimbursement in person.
These alternatives reinforce the right to petition, guaranteed by Article 5, Item XXXIV, of the Constitution.
Legal Impact of Institutional Partnership
The minister Jorge Messias emphasized that the cooperation between INSS, AGU, and public defenders reduces litigation and ensures expedited reimbursement. Additionally, it fulfills the principle of administrative efficiency, provided for in Article 37 of the Constitution.
In this way, the Public Defender’s Office takes center stage in defending retirees, reaffirming the state’s duty to provide comprehensive and free legal assistance.
The agreement, therefore, represents a legal milestone in the protection of pension rights, uniting administrative measures and constitutional guarantees in favor of the most vulnerable.
