The Cluster of Projects Awaiting Auction, Which Will Be Left for Another Government, Includes Components of Great Importance, Such as Road Projects, the Ferrogrão Concession, and Also the Proposal for Leasing the Container Megaterminal at the Port of Santos
The federal government will not finish the auction of at least eight projects that, initially, were supposed to be made public by the end of 2022. Although the number is lower than the number of points validated by the Ministry of Infrastructure, the set of projects awaiting auction that will be left for a future government contains relevant components, such as the Ferrogrão concession and the project for leasing the container megaterminal at the Port of Santos.
From the sector’s perspective, it is possible that the number of projects awaiting auction may increase further. The Ministry of Infrastructure still forecasts, for this year 2022, for example, the projects for the ports of Santos, Itajaí, and São Sebastião, as well as road projects.
Rafael Furtado, Secretary of Promotion, Planning, and Partnerships of the ministry, believes that the proposal for the Port of Santos will be announced to the TCU in mid-August. Following this proposal, the plan is to publish the bidding notice in October, which will depend on a decision from the court in less than three months.

Regarding the road auctions, the government has sought to broaden the range of operators, since individuals with established interests have been encouraged by the concessions arranged by the ministry in previous years. From the original document containing the projects that will go to auction, the licenses for BR-381 and the highway connecting Rio de Janeiro and Belo Horizonte (BR-040/495) have yet to reach the market. The six road projects awaiting auction, offered since 2019, require capital investments of around R$ 37.6 billion.
Delays in Projects Scheduled for Auction Are Due to Changes in Bidding Notices and Legal Actions
The reasons that motivated the delays in the auctions of the projects differ according to the projects; however, the three common issues are: incompatibilities between the market and the government that end up in court, as is the case with the Ferrogrão. Additionally, the project for a railway linking Mato Grosso to port terminals in Pará has been stalled since March in the Federal Supreme Court. The other reasons are processes for adjustments in the bidding models and the demand to prioritize some projects over others, due to a lack of technical staff to work on all of them.
Government Plans Auction of Road Projects Still This Year
The government intends to hold the auction, still this year, for lots 1 and 2 of the Paraná road package, which totals six, and the concession of BR-381 in Minas Gerais, modified after the bidding was waived due to a lack of interested parties at the beginning of the year. Currently, the highway will no longer be granted with BR-262. For highway 381, known as the “highway of death,” the government aims to send the new project to the Federal Court of Accounts by the end of August and conduct the auction by December.
For Rafael Furtado, if the Court validates the auction of the projects that are still under review by October, the government will be able to conduct the auction of these assets in 2022.
The same outlook applies to the lots in Paraná, the relicitation of the São Gonçalo do Amarante Airport (RN), and even for the new auction of Viracopos (SP). In the latter case, however, the official proposals from the ministry no longer foresee the auction for this year.
