A New Traffic Law Is Generating Controversy! Approved in the Chamber, the reform brings a new tax for drivers and changes the compulsory insurance. Find out how these changes will impact your pocket and the management of insurance.

A turnaround is coming for vehicle owners, and we are not talking about a simple change in traffic rules. The recent approval of a bill that alters the compulsory vehicle insurance promises to directly impact drivers’ wallets and reconfigure the automotive sector landscape.

With the new regulation, the consequences are deep and often controversial, generating a heated debate about the effectiveness and fairness of the measure. But what exactly is changing and how will it affect you?

What Changes With The New Regulation?

The Chamber of Deputies approved, in the form of a substitute from the rapporteur, deputy Carlos Zarattini (PT-SP), the Complementary Bill (PLP) 233/23.

The new text resumes the payment of medical expenses for victims of vehicle accidents, something that had been suspended previously.

In addition, between 35% and 40% of the amount raised from the insurance premium will be allocated to municipalities and states where there are public transportation services. The PLP will be sent to the Senate for final discussion.

Since 2021, Caixa Econômica Federal has operated compulsory insurance in an emergency manner, after the dissolution of the consortium of private insurers that managed DPVAT.

The funds raised until November of last year were sufficient to cover the indemnities, but the new regulation will allow the resumption of the insurance collection, which will now be managed by Caixa in a fund called Compulsory Insurance for Protection of Traffic Accident Victims (SPVAT).

Changes in Fiscal Framework and Financial Impact

During the reporting of the project, deputy Rubens Pereira Júnior (PT-MA) incorporated a change in the fiscal framework law. The possibility for the Executive to open supplementary credit was brought forward from 2024 to the first two months of 2024, due to the additional revenue growth compared to the previous year. The new fiscal law allows for an increase in expenses of approximately R$ 15.4 billion in 2024.

Due to the suspended payments of DPVAT because of lack of resources, the new SPVAT premiums may temporarily be higher to cover claims that occurred until the new fund comes into effect.

These amounts will be used to pay indemnities, judicial actions, technical provisioning, and insurance administration fees.

Examples of Payment of The New Tax

The new legislation stipulates that the compulsory insurance amounts will be adjusted to reflect the need to raise sufficient funds. For example, the new tax may range between R$ 40 and R$ 60 annually per vehicle, depending on the type and usage of the vehicle. For instance:

  • For a popular car, such as a Chevrolet Onix or Toyota Etios, for example, the SPVAT premium may be around R$ 50 per year.
  • For a luxury vehicle, such as a Volkswagen Tiguan, or Chevrolet Tracker, the amount may reach R$ 60 annually.
  • For motorcycles, such as a Honda CB 500, the premium may be adjusted to approximately R$ 45 per year.

News And Penalties

The approved text includes a penalty in the Brazilian Traffic Code (CTB) for non-payment of compulsory insurance, equated to a fine for serious violations.

The settlement of the insurance will be required for annual licensing, vehicle transfer, or its deregistration with traffic authorities.

In addition, the transfer of collected resources to the Unified Health System (SUS) will be reduced from 50% to 40%, with 5% allocated to the National Traffic System Coordination for the promotion of SPVAT and accident prevention programs.

Medical Expenses And Coverage

Although the government argues that excluding medical expenses could make premiums more affordable, Zarattini’s substitute includes coverage for medical and supplementary expenses, such as physiotherapy, medications, and orthopedic equipment.

Reimbursement will be permitted for expenses not covered by the SUS of the municipality of residence of the accident victim, and coverage will also extend to funeral services and rehabilitation for victims with partial disabilities.

The National Insurance Council (CNSP) will be responsible for establishing the limits of amounts to be indemnified and which expenses will be reimbursable.

The text prohibits the transfer of the right to receive the indemnity, following the order of heirs in the Civil Code. In cases of permanent disability, the indemnity amount will be calculated based on the percentage of acquired disability.

Indemnity payments will be made with simple proof of the accident and damage, regardless of fault or intent, and must be made by Caixa within 30 days after receiving the documents.

In case of delay, the payment will be adjusted by the Broad Consumer Price Index (IPCA) and overdue interest set by CNSP.

Controversies And Opinions

The return of the compulsory insurance tax is defended by some deputies as a way to ensure the rehabilitation of victims of traffic accidents.

However, there are criticisms regarding the exclusivity of Caixa Econômica Federal in managing the insurance, with suggestions that the private sector could also participate.

Deputy Chico Alencar (Psol-RJ) argues that the proposal represents a form of social solidarity, while others, such as deputy Marcel Van Hattem (Novo-RS), question the imposition of the insurance and the exclusion of private initiatives.

Pergunte para os mototaxiscista, vítimas de acidentes o quanto foram beneficiados até 2018. Foram bilhões de indenizações para medicamentos,tratamentos medicos,. Quem critica é pq não pesquisou e graças a Deus não precisou….

Vamos lá!

Diante de mais esta situação Ridicula neste país. Aonde o engraçado é que ninguém argumenta ou TEM **** para ficar trazendo, criando mais imposto.
Para que **** serve mesmo políticos neste país!? Um país Rico em tudo e o povo Brasileiro vivendo na Miseria e passando Fome, para ficar sustentando caprichos de quem Não Faz Nada neste país para favorecer o povo há não ser sugar, sugar, sugar…
Aqui no Brasil as Otoridades acham, acreditam estarem no Egito.

Vamos observar o seguinte, Aonde me causa estranhesa. Em um país aonde a droga não é liberada. Engracado se liberar para usar maconha. Agora vamos analisar aqui e perguntar aos gênios da lâmpada:
Se foi liberado a maconha, aonde é, e na mão de quem será comprado esta maconha? Aonde tambem nao mais se poderá prender o maconheiro porque o uso da droga foi liberado. Então alguém agraciou o patrão ora aqui denominado traficante tambem, pois para se realizar esta venda, a compra da maconha, será feita na mao do traficante. Isto chega ser irônico. A polícia nao vai mais poder prender nem o maconheiro, nem o traficante. Porque o traficante ele só estava vendendo a maconha que foi liberada por Brasília!
