New Law Eliminates The Requirement For Periodic Exams For Sufferers Of Terminal Illnesses, Reducing Bureaucracy And Guaranteeing More Security For Those Who Depend On The Benefit.
President Luiz Inácio Lula da Silva enacted on July 1, 2025, Law No. 15,157/2025, which amends the Social Security Benefits Law (Law No. 8,213/1991). The main innovation is the wavier of INSS examinations for individuals with irreversible diseases, such as HIV, Alzheimer’s, Amyotrophic Lateral Sclerosis (ALS), and Parkinson’s.
According to social security lawyer Tais Santos, this measure represents a milestone for millions of Brazilians living with disabling conditions who, until now, were required to undergo regular medical re-evaluations, even in cases with no prospect of cure. The estimate is that more than 4 million beneficiaries may be reached by the new rule.
How It Worked Before The New Law
Before the presidential sanction, all beneficiaries receiving sickness benefits, permanent disability retirement, or BPC/Loas could be summoned at any time by the INSS for new examinations.

The exemption from examinations applies to both administratively and judicially granted benefits.
That is, it does not matter if the right was recognized by the INSS or by the Judiciary: the beneficiary is protected.

Burla à lei sempre haverá, mas não é por isso que vai se deixar de dar dignidade aos segurados portadores de doenças incuráveis. Excelente gesto do presidente ao sancionar a referida lei.
Só que não o seu presidente foi obrigado a sancionar pois está mesma Lei ele vetor em 24/11/2024 como os deputados e Senadores derrubaram o veto dele e não tem saída ela não e tão bom assim..
