Farmers Who Own Properties in the Border Area of Mato Grosso do Sul Are Facing a Crucial Deadline: By October 2025, They Must Regularize Their Real Estate Registrations to Avoid Their Lands Being Expropriated and Incorporated into Federal Property. If Regularization Is Not Carried Out Within the Deadline, More Than 35,9 Thousand Farms May Be Affected, Covering 45 Municipalities and Totaling 13,7 Million Hectares.

This measure is a requirement of Law No. 13.178/2015, which regulates the granting of public lands in border areas. The aim is to ensure that all farms are properly registered and in compliance with current legislation.

Farmers in the Border Area Have Until October to Regularize Registrations

In Mato Grosso do Sul, farms located up to 150 kilometers from the border with Bolivia and Paraguay need to undergo a ratification process to ensure the legality of their real estate registrations. The final deadline for this regularization is October 22, 2025. Otherwise, the properties may be annulled and incorporated into federal lands.

The need for this regularization arises because these areas are considered strategic for national security. Thus, legislation requires stricter control over property titles.

The ratification of the real estate registrations of these farms is based on Law No. 13.178/2015, which stipulates that all properties located in the border area must prove their origin and be duly registered.

To reinforce this requirement, the Court of Justice of Mato Grosso do Sul (TJMS) published Provision No. 309 in July 2024, detailing the procedures that owners must follow to carry out the regularization.

Who Needs to Carry Out the Regularization?

Ponta Porã is within the 150 km border area with Paraguay and is one of the 45 municipalities in Mato Grosso do Sul affected by the requirement for land regularization. Farmers in the region need to update their registrations by October 22, 2025, or they may lose their lands to the federal government.

The requirement for ratification covers rural properties located in the border area that meet the following criteria:

  • They were acquired through titles granted by the states;
  • They have an area greater than 15 fiscal modules and less than 2,500 hectares.

Properties that already exceeded 2,500 hectares on October 22, 2015, cannot be regularized directly in the notary offices. For these cases, the ratification request must be made directly to the National Congress.

For properties with less than 15 fiscal modules, there is also a regularization requirement, but without a deadline set by the legislation.

Step by Step for the Regularization of Farms

To initiate the ratification of the real estate registration, farmers must gather the following documents:

  • Formal ratification request, informing the current registration of the property;
  • Complete ownership history, containing previous and updated certificates and registrations;
  • Technical report and plan, prepared by a qualified professional, proving the location of the property;
  • Public deed stating the absence of judicial or administrative disputes;
  • Negative certificates from the State Justice;
  • Updated Rural Property Registration Certificate (CCIR);
  • Georeferencing, mandatory for properties with more than 15 fiscal modules.

In addition to these documents, owners must also sign a declaration attesting that the property fulfills its social function, as determined by the Federal Constitution.

The process must be conducted in the property registration offices of the municipalities where the farms are located. If the property exceeds 2,500 hectares, the request must be sent to the National Congress.

What Happens If the Regularization Is Not Done?

Farmers who do not regularize their properties by the final deadline may lose their lands. This occurs because the absence of ratification can render possession titles null, allowing the lands to be incorporated into federal property.

Besides losing the farms, the lack of regularization can bring other problems for rural owners, such as:

  • Difficulty in accessing financing and agricultural incentive programs;
  • Legal insecurity, making the area less attractive to investors;
  • Risk of expropriation, affecting the local economy and regional development.

How Owners Can Seek Support?

To assist farmers in the regularization process, the Federation of Agriculture and Livestock of Mato Grosso do Sul (Famasul) is providing technical and legal support. The entity, in partnership with judicial bodies and notary offices, has developed booklets and informational materials to guide owners on the necessary steps.

The support materials are available on the websites of the responsible institutions, as well as in the property registration offices of the affected municipalities.

The measure affects 45 municipalities in Mato Grosso do Sul, including:

  • Ponta Porã
  • Corumbá
  • Dourados
  • Naviraí
  • Bela Vista
  • Aquidauana
  • Porto Murtinho
  • Maracaju
  • Sidrolândia
  • Itaquiraí
  • Jardim
  • Mundo Novo

With the final deadline approaching, it is essential that farmers seek the regularization of their properties as soon as possible to avoid future problems.
