The decision by the Federal Court of Accounts (TCU), announced last Wednesday (30), marks a new chapter for BR-101.
The stretch of 320.1 kilometers from the exit of the Rio-Niterói Bridge, in Rio de Janeiro, to the border with Espírito Santo, currently managed by the Arteris group, will undergo a concession process with new rules, including modern mechanisms for transparency and efficiency.
The measure aims to resolve the “stressed contracts” that, without continuous investments, result in halted works and losses for the population.
What Changes with the Renegotiation?
This change is part of the Ministry of Transport’s agenda to modernize road concessions that have become obsolete and thus unlock essential works.
Many of the current contracts, especially those signed in the 1990s, do not meet today’s infrastructure demands and quality standards required by users.
BR-101 has already become a priority, especially in the stretch that crosses Rio de Janeiro and Espírito Santo, where the poor pavement conditions and the absence of duplication and improvement works threaten safety and traffic flow.
With the renegotiation, the highway is expected to receive 65 kilometers of duplication and 55 kilometers of new lanes, in addition to optimizations for traffic and safety.
R$10.3 Billion in Improvements: Duplications, New Lanes, and Technology
To enable these improvements, the optimization project will account for R$10.3 billion in investments, which should cover various works and updates on BR-101. Among the main goals, the following stand out:
- 65 kilometers of duplication of the road;
- 55 kilometers of additional lanes to increase traffic capacity;
- Reinforcement of signage and improvements in user safety;
- Technological innovation in operations for greater efficiency and traffic control.
These improvements are anticipated with expectation, as they aim to increase driver safety and reduce recurrent traffic congestion on the road.
The Ministry of Transport and the TCU have determined that the project will also generate economic benefits for the region, boosting local sectors with the creation of jobs and income.

According to estimates, 87 thousand direct and indirect jobs will be generated with the renovation and expansion works of BR-101.

The publication of Ordinance No. 848, in August 2023, consolidated this new policy of contract readjustment, a strategy of the Ministry of Transport that aims to:
- Update contracts according to current public policy;
- Standardize documents between the government and concession companies;
- Immediately start expansion works;
- Advance execution timelines, optimizing resources and reducing tolls for users;
- Focus on works that are already licensed and at an advanced stage of analysis.
This new model seeks to ensure the fulfillment of contracts, avoiding the problems that marked previous concessions, and improving traffic flow and safety on BR-101 without unnecessary toll increases.
Reduction of Disputes and Greater Transparency
Another fundamental point in the renegotiation is the resolution of legal disputes.
To avoid conflicts and ensure contract execution, the renegotiated concession project provides for the waiver of pending legal, administrative, and arbitration processes.
The idea is to reduce litigation and associated costs, allowing works to proceed without interruptions.
