Recently, a new rule from the Brazilian Traffic Code (CTB) brought significant changes for drivers who engage in paid activities (EAR) and do not have this information registered on their National Driver’s License (CNH). The noncompliance with this requirement now results in a serious fine. This change can affect thousands of drivers who work in transportation of people or goods, such as taxi drivers, app drivers, truck drivers, and delivery riders, according to the video from the Manual do Trânsito channel.

The Importance of the “EAR” Information on the CNH

According to Article 147, Paragraph 5 of the CTB, the indication that the driver is engaged in paid activity must be recorded on the CNH. This specification was established to ensure that drivers who use their vehicles for paid work have the appropriate training, including the requirement to undergo a psychological evaluation (psychotechnical), similar to that required for those obtaining their first license.

The novelty is that, until recently, although there was a requirement to include this information on the license, there was no provision for a fine for those who violated the rule. This changed with the new regulation, which now provides for a serious penalty for drivers who engage in paid transportation without having the EAR designation registered on their CNH.

What Changes with the New Rule?

The main change is the inclusion of fines for those who engage in paid activities without proper registration on their CNH. The infraction is considered serious, resulting in a fine of R$ 293.47, in addition to the addition of seven points to the driver’s license. The penalty is detailed in Article 231, item 8 of the CTB, which mentions the paid transportation of people or goods without proper authorization.

This change is part of the new Brazilian Traffic Inspection Manual, which has introduced this measure to close the gap that existed until now. Previously, the driver could engage in paid transportation, but if they did not have the “EAR” information on their CNH, there was no clearly defined infraction to punish them. Now, noncompliance with this requirement can hit the wallet and the points on the license.

Who Will Be Affected?

The change directly affects drivers who transport people and goods for a fee, such as:

  1. App Drivers (Uber, 99, etc.): These professionals should be aware of the new rule and ensure that their CNH contains the EAR information to avoid issues during potential inspections.
  2. Taxi Drivers and School Transport Drivers: Professionals who regularly transport passengers also need to keep their documentation up to date. The absence of this information can lead to penalties.
  3. Delivery Riders and Couriers: The transportation of goods is also included in the new rule. Even those who use motorcycles for deliveries must have the EAR registered on their license.

Additionally, any driver who uses their vehicle for paid activities, whether continuously or occasionally, must follow the new regulation.

How to Regulate the Situation?

For drivers who do not yet have the EAR registered on their CNH, the regulation process is relatively simple. The first step is to schedule a psychological evaluation (psychotechnical) at the Detran in their area. The exam is similar to what is performed for those obtaining their first license and aims to assess whether the driver is fit to engage in paid activities behind the wheel.

After passing the exam, the driver can request the inclusion of the EAR information on their CNH. It is important to remember that this inclusion can be made both during the Learning Permit (PPD) and on the definitive National Driver’s License, meaning that drivers who are still on a provisional license may also apply for the change.

A intenção do governo é mesmo arrecadar impostos. Essa avaliação psicológica e difícil que demora mais de uma hora e com tempo serve para ver se você não tem problemas de atenção e reflexo no trânsito. Coisa que ja era pra ser inclusa nas aulas de CNH. E não tem uma base explicando a importância de entregar mercadorias ou pessoas com segurança, é um processo muito mecânico.
