It is important to highlight that this change is directly related to the National Driver’s License (CNH).

The fact is that the bill 2.955/2021, presented by Senator Eduardo Gomes (MDB-TO), allows drivers to operate only automatic vehicles. Additionally, the bill prohibits drivers licensed in this category from operating manual transmission cars. In short, the new bill would change the Traffic Code.
Thus, a candidate wishing to obtain their CNH for automatic cars would have the right to choose to take the driving test in a vehicle with automatic transmission, always in accordance with the National Traffic Council.

After passing the exam, the driver has the right to operate vehicles only with this type of transmission. With the new automatic transmission law, if the driver is caught in a vehicle with manual transmission, they would be committing a severe infraction, being fined and having the vehicle seized until a licensed driver for manual cars arrives.
Another important point of the new automatic car transmission law is that the driver could remove the restriction whenever they wanted, needing only to take a driving test in a manual transmission vehicle.
Advantages and Disadvantages of the New Automatic Transmission Law
Among the advantages are accessibility and safety. Firstly, the theoretical exam on automatic cars makes obtaining the CNH more accessible for those wishing to drive only automatic vehicles, aligning the driver training process with the market reality.
Furthermore, by providing a theoretical understanding of how automatic cars work, drivers can feel safer and more prepared to handle these vehicles. This reduces the likelihood of accidents due to a lack of knowledge.
On the other hand, disadvantages include the restriction of practical skills and added complexity. The lack of practical lessons in automatic cars may leave new drivers with less experience in operating these vehicles in practice, which can be a disadvantage when facing real traffic situations.
Moreover, the inclusion of a specific theoretical exam for automatic cars may add complexity to the CNH acquisition process, making it more bureaucratic and challenging for candidates.
Other Countries Have Already Adopted Automatic Car Transmission Laws
The senator responsible for the bill, Eduardo Gomes, states that legislation needs to be in tune with the evolution of cars. Additionally, the parliamentarian claims that in Brazil, automatic cars are being sold extensively.
However, licensing exams are still required to be conducted with manual transmission vehicles, per a resolution by the Contran. Other countries have already implemented the new automatic transmission law. In the United Kingdom, for example, there is a clear distinction between licenses for manual car drivers and for automatic transmission cars.
In practice, passing the driving test in an automatic vehicle limits the license holder to driving only automatics. On the other hand, those who pass the test in a manual vehicle have the flexibility to drive both types of vehicles.
Germany also mirrors the United Kingdom’s approach to the new automatic transmission law, in such a way that passing the test in an automatic car licenses the driver exclusively for automatic vehicles.
