In the current scenario of Brazilian traffic, electronic surveillance has become omnipresent, with speed cameras spread across various urban roads and highways.

The technology, initially implemented to enhance road safety and reduce accidents, has begun to directly impact professional drivers, who depend on their licenses to carry out their daily activities.

In this context, a new legislative proposal suggests increasing the points limit on the National Driver’s License (CNH) for professional drivers, allowing these workers greater leeway before license suspension.

The project aims to take into account the growth of electronic surveillance and its impact on drivers who spend several hours a day on the streets and roads of the country.

Proposal Details

The Bill 2002/24, authored by Representative Carla Zambelli (PL-SP), proposes raising the limit to 80 points for the suspension of the CNH for professional drivers over a period of 12 months.

Currently, the Brazilian Traffic Code (CTB) provides for suspension in the following cases:

  • 20 points, when there are two or more serious violations;
  • 30 points, when there is one serious violation;
  • 40 points, when there are no serious violations.

In addition to the increase in the points limit, the proposal allows drivers with 70 points to anticipate a preventive recycling course to avoid license suspension.

The intention is to ensure that these professionals can continue driving, safeguarding their source of income.

The measure would apply to app drivers (Uber, 99, InDrive), truck drivers, taxi drivers, bus drivers, and other workers in the sector who use their vehicles as essential tools for their livelihoods.

Rationale Of The Author About The Law For Drivers

Representative Carla Zambelli argues that traffic legislation has not kept pace with the evolution of electronic surveillance.

In the past, speed cameras were installed in critical locations with technical justifications.

However, currently, the devices have multiplied, often without rigorous studies on their real necessity, causing drivers to accumulate points rapidly.

She emphasizes that for drivers who spend eight, ten, or even twelve hours a day driving, the likelihood of incurring minor and medium violations throughout the year is much higher.

This places these professionals at constant risk of losing their CNH, even without having a history of dangerous driving or serious violations of traffic rules.

The representative also highlights that the loss of the license has a severe social and economic impact, as it can prevent a worker from supporting their family and fulfilling their financial commitments.

Impact of The Proposal for App Drivers and Truck Drivers

If approved, app drivers and truck drivers will be directly benefited, as they are among the categories most affected by electronic surveillance.

Drivers on platforms like Uber and 99 often report difficulties in maintaining their valid CNH, as they need to drive long distances and often face poorly marked speed cameras or constantly changing traffic rules without proper warning.

Truck drivers, in turn, traverse different states and cities, each with its own surveillance structure, increasing the risk of accumulating violations without noticing.

For these workers, the possibility of having 80 points before suspension could mean continuity in their professional activities without so many uncertainties.

Surveillance and Increased Traffic Safety

Traffic specialists are divided on the proposal. While some support the measure as a form of justice for professional drivers, others warn of possible consequences for road safety.

For proponents of the change, the project does not encourage disrespect for traffic laws, as serious violations, such as driving under the influence or running a red light at high speed, will continue to incur severe penalties.

Additionally, the recycling course for drivers reaching 70 points could encourage more responsible and preventive driving.

On the other hand, critics of the proposal argue that increasing the points limit may weaken the educational effect of the penalty system.

They point out that drivers may feel more “free” to commit violations, as the suspension of the CNH would be further away.

What Do Sector Entities Say?

Representative organizations for drivers, such as taxi unions and truck driver associations, support the change.

According to them, the proposal takes into account the reality of these professionals, who live an intense routine of commuting and are sometimes penalized for unavoidable situations.

On the other hand, organizations connected to traffic safety express concerns, stating that reducing the effectiveness of penalties could lead to increased disrespect for traffic rules and, consequently, more accidents.

The Legislative Path of The Proposal

The Bill 2002/24 will be analyzed conclusively by the Committees of Transportation and Traffic; Constitution, Justice, and Citizenship of the Chamber of Deputies.

If approved, it will proceed to the Federal Senate and subsequently to presidential sanction.

The processing may take months or even years, depending on the priority given to the subject and the pressure from interested sectors.

However, the debate is already underway and has engaged parliamentarians, drivers, and traffic specialists.

For specialists, the proposal to increase the points limit for professional drivers is an attempt to balance traffic oversight with the reality of drivers who rely on their CNH to work.

The project recognizes that the intensification of speed cameras and modernization of electronic surveillance directly impact these workers, jeopardizing their main source of income.

The change, if approved, does not eliminate drivers’ responsibility but seeks to offer a larger safety margin before license suspension.

Thus, the goal is to prevent professionals from being negatively affected by an accumulation of violations that often do not reflect reckless driving, but rather excessive oversight in certain areas.

The debate continues, and the proposal will undoubtedly face resistance from some sectors. However, the support from drivers and associations could be decisive for its approval in the National Congress.
