Despite the rule, there are frequent reports of passengers claiming to have faced resistance from drivers when asking to turn on the equipment.
On the other hand, some drivers argue that keeping the air conditioning on at all times increases fuel consumption and incurs additional costs.
This mismatch of expectations has already resulted in tense situations, such as cancellations, negative ratings, and arguments during the ride.

Incident in Praia Grande Reveals a Problem
It was in Praia Grande, on the coast of São Paulo, that one of these conflicts reached a severe level.
Recently, a family requested a ride in an Uber car and asked the driver to turn on the air conditioning. The request was immediately denied, causing discomfort and confusion.
The refusal escalated into a discussion, which ended with the cancellation of the ride and the passengers being removed from the vehicle.
Assault Captured by Cameras
The incident did not end there. According to images from security cameras in nearby residences, when removing belongings from the trunk, the passenger’s son left the door open.
This action provoked the driver’s fury, who punched the young man in the face. The boy did not react, but the moment was captured on video and served as evidence for the report. The mother reported experiencing moments of panic.
“When politely asking the driver to turn on the air, he responded that he wouldn’t do it because the car was his. I questioned him, explaining that by registering in this category, he should be aware that customers can request this service. My reaction was to prevent my son from reacting, as he trains jiu-jitsu and knows how to defend himself, but I was very afraid that the driver was armed and would kill us. We were all in panic,” she said.
Repercussions and Uber’s Measures
In an official statement, Uber classified the driver’s conduct as unacceptable and reported that he has been banned from the platform.
The company emphasized that safety and respect are pillars of the service and reminded users they can report inappropriate behavior directly through the app.
Legal Responsibility
In addition to Uber’s internal measures, incidents of violence during rides can result in criminal and civil consequences.
In the Praia Grande incident, the driver could be charged with bodily injury, as defined in the Penal Code, in addition to being subject to compensation for moral and material damages.
Consumer law experts highlight that, as it is a paid service, the refusal to turn on the air conditioning may constitute a breach of contract, reinforcing the provider’s responsibility.

Similar Situations in the Country
Although the case in Praia Grande gained attention, other incidents of disagreement between drivers and passengers have been reported in different cities across Brazil.
In Belo Horizonte, passengers reported in 2024 that drivers turned off the air conditioning during the ride to save fuel.
In Recife, a ride ended in a police report after a driver refused to turn on the equipment and expelled the customers from the car.
These examples show that the lack of consensus around basic rules can escalate into situations of insecurity.
