The Government Did Not Increase The IPTU Rate Or The Inheritance Tax, It Changed The Calculation Base To The Real Market Value, Which Will Multiply The Burden On The Middle Class.
The New Rule From The IRS Will Deeply Change The Way Properties Are Taxed In Brazil Starting In 2026, According To Rob Correa, Lawyer And Analyst. Although The Rates Of The IPTU And The Inheritance Tax (ITCMD) Have Not Been Changed, The Calculation Base Will Consider The Real Market Value Of The Properties, No Longer Outdated Tables Used So Far.
In Practice, Those Who Own Properties In Valued Neighborhoods Or Received Inherited Wealth May Feel A Significant Increase In Taxes. Rob Correa Warns That Many Families Will Have To Review Their Financial Planning To Avoid The Payment Of These Obligations Leading To Forced Sales Of Assets.
What Has Changed With The New IRS Rule, According To Lawyer Rob Correa
The New Rule From The IRS Was Made Possible By The Creation Of The Brazilian Real Estate Register (CIB), Which Assigns A Unique Code To Each Property, And The CTER, A System That Integrates Notaries, States, Municipalities, And The IRS. This Integration Will Allow Information About Property Values To Be Sent In Real Time To A National Database.

Until Now, The IPTU Was Calculated Based On Generic Value Templates, Usually Well Below Market Price. With The Update, The Reference Value Will Be Adjusted According To Market Reality, Automatically Increasing Taxes In High-Value Areas.
Impact On IPTU: Higher Bills Every Year
For Those Living In Large Urban Centers Or In Neighborhoods That Have Appreciated Significantly In Recent Years, The New Rule From The IRS Means The IPTU Will Be More Expensive. While It Was Previously Possible To Pay Less Because The Property Was Undervalued In Official Tables, Now The Charge Will Be Based On The Real Price.
This Directly Affects The Middle Class, Which Often Relies On Their Own Property As Wealth Accumulated Over A Lifetime. The Appreciation Of The Neighborhood, Once A Cause For Celebration, May Become A Burden On The Budget.
Inheritance Tax Will Also Be Affected
The Inheritance Tax (ITCMD) Is Another That Will Be Impacted. Until Now, Many Property Transfer Records Were Made With Lower Values To Reduce The Calculation Base. With The New Rule From The IRS, This Will No Longer Be Possible.
If A Property Is Worth R$ 1 Million In The Market, The Tax Will Be Calculated On That Full Value. This Means That Inheriting Families May Be Forced To Sell Part Of The Assets Just To Cover The Tax. The Same Applies To Gifts Given During Life, Which Also Fall Into This Category.
How To Prepare For The Change
Experts Recommend That Families Adopt Protective Measures Right Away. Among Them:
- Liquidity Reserve To Cover The Annual IPTU Without Compromising The Budget.
- Succession Planning, Such As Insurance Or Creating Family Holdings, To Reduce The Impact Of The ITCMD.
- Asset Protection, Restructuring The Way Properties Are Registered, To Avoid Higher Costs.
These Measures Can Be Decisive To Prevent The Charges From Leading To The Loss Of Valuable Properties In Poorly Planned Inheritances Or Successions.
The New Rule From The IRS Does Not Change Rates, But Completely Alters The Calculation Base For Taxes. This Can Mean A Significant Increase In IPTU And Inheritance Tax, Directly Affecting Families Who Have Properties As Their Main Asset.
