The Consumer Defense Commission of the Chamber approved a project that establishes the new right for the elderly to receive credit card bills in accessible format for free, including printed, with physical, digital, or email delivery, establishing a minimum deadline of five days.

New Right For The Elderly Guarantees Free Delivery And Format Option

The text guarantees the new right of the elderly to opt for the free receipt of credit card bills and statements in accessible format, including printed paper. The measure allows elderly individuals to choose the format that best meets their needs.

According to the project, delivery may occur by physical mail, email, or another format that allows for printing. The new right for the elderly establishes that clients aged 80 or over will have priority in service and guarantee free delivery when requested.

The rapporteur emphasized that the new text ensures the elderly’s choice of the most suitable format for receiving statements, including digital, and reinforces protection against discriminatory practices in access to financial services.

Changes To Bill 1930/23 And Deadline Adjustments

The approved proposal is the substitute presented by Deputy Ossesio Silva from the Republicans of Pernambuco to Bill 1930/23, authored by Deputy Júnior Mano from the PSB of Ceará.

The author argues that many elderly individuals report difficulty in accessing and understanding information in digital format. The justification supports the creation of the new right for the elderly, aimed at increasing access to financial information.

Originally, the text provided that the physical bill be delivered with a minimum advance of ten days before expiration. The substitute reduced this deadline to five days, adjusting the proposal to the reality of card operators, according to the rapporteur.

New Right For The Elderly And Changes To The Statute Of The Elderly

The substitute also alters the Statute of the Elderly. It will now be defined as a discriminatory practice the requirement for in-person attendance by elderly individuals when this requirement is not extended to other audiences, unless legally provided.

According to the rapporteur, the new right for the elderly reinforces protection against the requirement of physical presence in situations where other consumers can perform operations remotely. The measure seeks to ensure equal treatment in access to financial services.

The approved text consolidates the new right for the elderly as a tool for ensuring choice and combating practices considered discriminatory in banking and card services.

Processing And Next Steps For The New Right For The Elderly

After the approval by the Consumer Defense Commission, the proposal will be analyzed conclusively by the Commission on Constitution, Justice, and Citizenship.

For the new right for the elderly to come into effect, the text still needs to be approved by the Chamber of Deputies and the Senate. Only after the completion of these stages can the project become law.

The processing follows the legislative procedures provided, maintaining the content approved in the substitute presented by the rapporteur. The new right for the elderly remains conditional upon final approval in both Houses.
