The Chamber of Deputies Approves Bill That Prohibits Filling the Tank to the Brim; Measure Aims to Reduce Risks and Fines for Gas Stations.

The common practice of filling a car’s tank to the brim, known as “filling to the brim,” is about to change. The Economic Development Committee of the Chamber of Deputies has approved a new Bill (PL) aimed at imposing fines for this practice at gas stations. The goal is to enhance safety and prevent accidents, as well as regulate the refueling procedure.

Details of the Bill

The Bill, reported by Deputy Augusto Coutinho (Republicanos-PE), establishes that gas stations must cease refueling when the pump shutoff is activated.

The proposal also requires establishments to install posters or informative signs about this prohibition.

The intent is for drivers to be alerted about the new rules and avoid excessive refueling.

The measure was a modification of Bills 7817/17 and 8282/17, which were previously analyzed.

The substitute approved by the Health Committee had already been accepted, but the final version of the bill brought significant changes.

Now, the fine for gas stations that violate the rule will range from R$ 20,000 to R$ 1 million, but only in cases of recurrence.

Initially, the fine also applied to first offenses, which raised concerns about the excessive penalization of gas station owners.

The rapporteur of the bill, Deputy Augusto Coutinho, explained the reason for the change. According to him, the initial fine could be disproportionate, especially when the gas station owner does not have direct control over the actions of the attendants.

“There is concern about the imposition of a heavy fine on the owner of the station when they often do not know what is happening. In the concrete case, the responsibility lies with the attendant,” said Coutinho.

For this reason, he suggested that initially, owners should receive a warning, and only in cases of recurrence would financial sanctions be applied.

Additionally, the bill takes into account the risk of accidents associated with fuel spills.

When the tank is filled beyond capacity, fuel can overflow, increasing the risks of explosion and fire.

The measure thus aims to improve safety for both consumers and gas station employees.

Next Steps

The Bill still needs to go through other stages before becoming law and fines can be applied.

In a conclusive manner, it will be analyzed by the Committees on Industry, Commerce and Services, and Constitution, Justice and Citizenship.

After this analysis, the text will proceed to a vote in the Senate. If approved, the bill will have a significant impact on how vehicle refueling is conducted in Brazil.

The measure is an example of how the legislature seeks to deal with practices that may pose risks to public safety through fines.

The prohibition of filling the tank to the brim is an attempt to minimize dangers associated with refueling and promote responsibility among both drivers and gas stations.
