The Banco Pan S/A was fined R$ 13,522,436.17 by Procon-SP for continuing to make telemarketing calls to consumers who were already registered in the “Do Not Call” program. The sanction was applied based on three fundamental criteria that guide the accountability of companies in cases of violations of consumer rights. The first criterion considered was the seriousness of the infraction, which evaluated the negative impact of the practices adopted by Banco Pan on the affected consumers.
Next, the economic size of the institution was taken into account, meaning its financial capacity and structure, which directly influence the penalty amount. Finally, the decision was based on the guidelines established by the Consumer Defense Code, which ensures the protection of citizens’ rights against abuses by companies and financial institutions. These three elements were decisive for the imposition of the penalty in a proportional and fair manner.
