The Decision of the National Council for Energy Policy (CNPE) on Oil and Gas Production Allows the Extension of Sharing Contracts, Bringing Regulatory Security, Predictability, and Stimulus to Investments in Brazil

Oil and gas production in Brazil gained new momentum with the approval of guidelines that allow the extension of sharing contracts, according to a report published.

The decision, made by the National Council for Energy Policy (CNPE), took place on October 1st and paves the way for more predictability and greater utilization of the country’s strategic reserves.

Until now, contracts did not have specific clauses for extension, which created uncertainty for operators and investors.

Now, under Law No. 15.075/2024, the CNPE will regulate extension periods, offering clarity for all involved.

This advancement has a direct impact on the future of oil and gas production, as it allows for the continuation of exploration for up to an additional 27 years, provided that the operation demonstrates technical and economic viability.

In practice, the measure ensures that investments are better planned and that the Union reaps more lasting benefits.

The Minister of Mines and Energy, Alexandre Silveira, emphasized that the new model strengthens the attractiveness of investments and ensures that public resources obtained from oil and gas production are reinvested in national development.

With this decision, Brazil reinforces its position as one of the world’s leading energy hubs, attracting capital and stimulating new long-term projects.

The Importance of ANP in Monitoring the Rules

Among the most relevant points is the role of the National Agency of Petroleum, Natural Gas and Biofuels (ANP).

The agency will be responsible for evaluating extension requests, always considering the technical criteria defined by the CNPE.

In this way, oil and gas production remains aligned with regulatory standards and with the development plans presented by companies.

This role of the ANP ensures balance between public and private interests. For operators, there is more clarity about the requirements necessary to extend contracts; for the country, it ensures that strategic reserves are explored efficiently.

With the possibility of extending sharing contracts for up to 27 years, oil and gas production in Brazil now has a more stable horizon.
