New Unemployment Benefit Cap Reflects Minimum Wage Adjustment and Can Be Accessed by Those Who Were Dismissed Without Cause
Workers who were employed with a formal contract in the last 18 months and were dismissed without cause may be entitled to withdraw up to R$ 2,424.11 in installments of the unemployment benefit. The updated amount follows the new minimum wage, set at R$ 1,518, and takes into account the accumulated inflation measured by the INPC.
With the changes, the benefit now follows a revised salary bracket table. The cap of R$ 2,424 is designated for those who earned salaries above R$ 3,564.96. The other amounts follow a progressive formula defined by Law No. 7,998/1990, which regulates the program.
Who Is Entitled to the Benefit?

The unemployment benefit is a right of the formal worker who has been dismised without cause and is unemployed at the time of the request. The number of months worked varies according to the request:

- 1st request: at least 12 months with a formal contract in the last 18 months.
- 2nd request: minimum of 9 months in the last 12 months.
- From the 3rd request: at least 6 months of employment before dismissal is required.
In addition, it is necessary not to have sufficient personal income for your maintenance and that of your family and not to be receiving ongoing social security benefits, except for accident aid or death pension.
How Is the Amount Calculated?

The updated calculation table defines the following criteria:
- For salaries of up to R$ 2,138.76: 80% of the average value is applied.
- For salaries between R$ 2,138.77 and R$ 3,564.96: the amount exceeding R$ 2,138.76 is multiplied by 0.5 and R$ 1,711.01 is added.
- For salaries above R$ 3,564.96: the fixed amount is the cap of R$ 2,424.11.
These amounts are based on the average salary of the last three months before dismissal. The number of installments varies from 3 to 5, depending on the formal employment history.
How to Apply for the Unemployment Benefit?
The process has been digitized to facilitate access:
- Online, through the Gov.br Portal
- Digital Work Card App
- In-person at SINE units or Regional Labor Superintendencies (SRTEs)
After dismissal, the worker must wait from 7 to 120 days to make the request, respecting the maximum deadline set by law.
Why Was the Amount Adjusted?
The unemployment benefit adjustment is linked to the increase in the minimum wage, which rose to R$ 1,518 in 2025, and the National Consumer Price Index (INPC). The aim is to preserve the purchasing power of the dismissed worker, compensating for inflation.
