Refit (Refinery of Manguinhos) filed a new statement in the Federal Court accusing the ANP (National Agency of Petroleum, Natural Gas and Biofuels) of failing to comply with a court order that suspended administrative deliberations related to the interdiction of the unit located in RJ. According to a publication by SBT News this Monday (26), the case involves regulatory disputes, questions about administrative impartiality, and allegations of abuse of authority, with potential direct impact on the fuel sector and the Brazilian regulatory environment.

Refit Accuses ANP of Noncompliance with Court Order and Maintaining Interdiction in RJ

Refit claims that the ANP undermined the practical effects of the injunction granted by the Federal Regional Court of the 1st Region. According to the company, even after the court decision, the agency continued inspections, instructive actions, and administrative movements related to the partial interdiction of the Manguinhos refinery in RJ.

For Refit, these actions directly affront the authority of the Federal Court. The company requests the blocking of new administrative acts and an investigation into possible abuse of authority by ANP officials, arguing that the continuation of actions undermines the concrete effects of the court decision.

What the Federal Court Injunction Against the ANP Determines

The injunction was granted in December by Judge Newton Pereira Ramos Neto of the TRF-1. The decision prevented the ANP board from deliberating on the case, until the process rapporteur conducts a more in-depth analysis of the arguments presented.

However, according to SBT News’ investigation, the court decision did not suspend the entire administrative process. Activities such as inspections, production of technical reports, submission of documents, and procedural instructions would still be allowed, as long as they did not involve final deliberation by the board.

This point is central to the legal controversy. While Refit believes that any subsequent action undermines the effectiveness of the injunction, the ANP maintains that it strictly adhered to the limits set by the Federal Court.

Refit, ANP, and the Debate on the Suspicions of the Director

One of the main arguments presented by Refit involves the actions of Director Pietro Mendes, randomly appointed rapporteur for the company’s appeal within the ANP. The refinery argues that there would be a conflict of interest, as Mendes previously chaired the board of directors of Petrobras, a competing company in the refining sector.

Sector agents assess that the thesis does not find automatic legal support. Brazilian legislation does not consider prior involvement in a company in the sector as a disqualification for working in a regulatory agency.

Moreover, ANP decisions are collegial. In the case of the interdiction of the distillation tower of Manguinhos refinery, the understanding was unanimous among the five directors, which would reduce any practical impact of a possible individual disqualification.

Refit also requested the removal of Director Symone Araújo, alleging that she participated in the inspection operation that led to the partial interdiction of the unit in RJ.

According to sources in the regulatory sector, institutional participation in inspection actions does not preclude subsequent judgment of administrative appeals. This understanding is widely adopted in administrative law and in the practice of regulatory agencies.

The ANP maintains that its actions followed technical and legal standards, without any conflict of interest or violation of due process.

Another sensitive point raised by Refit is the alleged attempt by the ANP to validate acts deemed null through changes or reinterpretations of internal rules, which would have been applied retroactively.

Agency interlocutors rebut the accusation and assert that there was no normative change. According to the ANP, their actions were limited to the application of existing rules, based on technical findings obtained during inspections.

Among the main technical findings, the ANP pointed out that Refit was not effectively operating as a refinery, but as a fuel formulator, despite holding authorizations and regulatory benefits typical of refining.

According to the administrative records, the distillation tower did not meet adequate technical operating conditions, which motivated the continuation of the partial interdiction. Of the 11 activities initially suspended, ten were subsequently released, leaving only the operation of the tower restricted.

This technical point supports the ANP’s position and justifies the continuation of inspection actions, even in the face of the injunction in effect.

Abuse of Authority and Legal Interpretation

Refit also requested that the Federal Court investigate possible abuse of authority by ANP officials. According to evaluations from agency interlocutors, this accusation is treated as legal rhetoric.

In technical analysis, disagreements over regulatory interpretation or the scope of court decisions do not, in themselves, constitute criminal wrongdoing. To characterize abuse of authority, specific intent or a clear deviation from purpose would need to be proven.

History of Investigations Involving Refit in RJ

The Manguinhos refinery was the target of Operation Carbon Chain, which investigated irregularities in the import and marketing of fuels. In September, the ANP interdicted the unit after identifying failures in 11 operational activities.

Subsequently, ten of those activities were released, leaving only the interdiction of the distillation tower in place. In November, companies linked to Refit’s controlling group again faced investigations in Operation Well of Lobato, with search and seizure warrants executed in five States and the Federal District.

These precedents increase the complexity of the case and help explain the strict stance taken by the ANP.
