Who Applied For Retirement By Age In 2019 May Be Entitled To A Review That Multiplies The Benefit, Because The Application Was Made Under One Law And The Approval Occurred Under Another.

A new possibility for review may transform the retirement by age of thousands of insured individuals in Brazil. The central point lies in applications made in 2019, the year the Pension Reform came into effect. In these cases, the law guarantees that the most advantageous rule is applied, which can increase benefits from a minimum wage to values close to R$ 4,000.

According to Advocacia Gasparotto, this review is provided for in the legislation itself and in internal regulations of the INSS, without depending on ruling from the Supreme Federal Court (STF). This makes the process more straightforward and secure for those who meet the requirements.

Who Is Entitled To The Review

Unprecedented Review Can Increase Retirement By Age From A Minimum Wage To Up To R$ 4 Thousand: Insured Individuals From 2019 Are Entitled To It And Are Owed R$ 200 Thousand In Arrears

The year 2019 was decisive because Constitutional Amendment 103, known as the Pension Reform, came into effect on November 13.

Many insured individuals applied for retirement by age before that date but only had their approvals finalized afterward.

In that interim, a so-called conflict of rules occurred:

The application was made under the previous legislation, but the benefit was granted while the new norm was already in effect.

The law and the normative instruction of the INSS determine that, in this case, the worker can choose the more beneficial rule.

How Much The Value Can Increase

A case analyzed by Advocacia Gasparotto shows the real impact.

An insured individual who requested retirement on August 28, 2019, but only had the benefit granted on December 10 of that year, began receiving a minimum wage (R$ 998 at that time).

With the review, the initial amount would rise to R$ 2,945.05.

Updated for 2025, this benefit should be around R$ 3,985.68.

The monthly difference exceeds R$ 2,400, and the accumulated arrears over five years reach over R$ 200,000.

Where To Seek The Review And What Documents To Present

To claim the right, the retiree needs to file a judicial action requesting the application of the more advantageous rule.

It is essential to present:

Retirement grant letter.

Complete CNIS statement (contribution history).

Documents that prove the dates of application and approval.

According to Advocacia Gasparotto, only a technical analysis can confirm whether the review actually increases the benefit amount and accurately calculate the arrears.

Why This Review Is Little Known

Unlike the so-called “Review of the Whole Life,” which still depends on rulings from the STF, this modality is directly supported by law and regulations from the INSS.

Thus, according to Advocacia Gasparotto, the process tends to be faster and safer, as it does not rely on broad judicial interpretations.

The fact that it is not prominently featured in the media leads many insured individuals to simply be unaware that they could multiply their retirement by age and still receive significant retroactive amounts.

Experts assess that, for those who retired by age in 2019 and received the grant after the Pension Reform, this review can represent a unique opportunity.

In some cases, it means going from the minimum wage to amounts close to R$ 4,000 monthly, in addition to arrears exceeding R$ 200,000.

Advocacia Gasparotto recommends that each insured individual consult documentation and perform personalized calculations before filing a judicial action, ensuring that the process truly brings benefits.

The possibility of increasing the retirement by age through this unprecedented review shows how legal details can transform the financial lives of many Brazilians. For those insured in 2019, it is a right that can mean more dignity in retirement and significant amounts in arrears.

Do you know anyone who applied for retirement by age in 2019 and might be in this situation? Do you think it’s fair that insured individuals receive the more advantageous rule even after the reform? Share your opinion in the comments — we want to hear from those who experience this in practice.
