High Constant Noise Can Be Solved Without Relying Solely on the Police: With Documented Evidence and Extra-Judicial Notification (Art. 726, CPC), the Resident Can Stop the Disturbance and Even File for Damages (Art. 42, LCP).
The noise from the neighbor is one of the main causes of conflict in condominiums and residential neighborhoods. Although many turn to the police, this solution tends to be temporary: the patrol car leaves and the problem returns. Experts like lawyer Cíntia Brunelli explain that the fastest and most effective way is through the use of civil tools, supported by law, which give the resident means to demand respect and even seek damages in court.
According to Brunelli, Brazilian legislation already provides clear measures: Art. 42 of the Law of Contraventions categorizes excessive noise as a disturbance of peace, but the practical application is slow. What really makes a difference is the strategy of gathering evidence and contacting the neighbor through a formal extra-judicial notification.
How the Law Frames Neighbor Noise
The first point is to understand that the problem is not treated as a “crime,” but rather as a criminal contravention, subject to fines or simple imprisonment.
-
Larger than entire cities in Brazil: BYD is building a 4.6 km² complex in Bahia with a capacity for 600,000 vehicles per year, but the discovery of 163 workers in conditions analogous to slavery has shaken the entire project.
-
With an investment of R$ 612 million, a capacity to process 1.2 million liters of milk per day, Piracanjuba inaugurates a mega cheese factory that increases national production, reduces dependence on imports, and repositions Brazil on the global dairy map.
-
Brazilian city gains industrial hub for 85 companies that is equivalent to 55 football fields.
-
Peugeot and Citroën factory in Argentina cuts production by half and opens a layoff program for more than 2,000 employees after Brazil drastically reduced purchases of Argentine vehicles.
The report can be made via a police report, including online, but this generally does not resolve the case.
In practice, experts recommend that the criminal aspect be seen as support, while the main solution should come from the civil side, which allows requesting the judge to both stop the noise and seek compensation for moral damages when proven.
The Importance of Evidence in the Process
For the Justice system to accept the complaint, it is essential to gather evidence.
Videos, occurrence records, and even testimonies from other neighbors are fundamental.
The more documents the resident has, the stronger the argument will be.
This evidence serves to prove the recurrence of the problem and demonstrate to the judge that it is not an isolated inconvenience, but a pattern of disturbance affecting the quality of life.
Extra-Judicial Notification: The Game Changer
The decisive step is the extra-judicial notification based on Art. 726 of the Code of Civil Procedure.
This is a formal notice sent to the neighbor, with a deadline for them to cease the behavior under the threat of legal action.
This document must be sent by mail with acknowledgment of receipt (AR), ensuring proof that the recipient received the communication.
The letter needs to describe the problem, set a deadline for resolution, and make it clear that if the noise continues, a lawsuit will be filed seeking damages.
When to Bring the Case to the Special Civil Court
If, even after the notification, the noise persists, the next step is to appeal to the Special Civil Court, which handles less complex cases.
There, it is possible to ask the judge to order the obligation to cease the noise and, depending on the severity, to impose damages for moral harm.
All gathered material — videos, notifications with AR, police reports — should be attached to the case. This increases the chance of success and shows that the resident sought an extra-judicial solution before involving the Justice system.
Experience shows that fines and imprisonment rarely resolve the problem permanently.
The civil route, structured with evidence and extra-judicial notification, tends to be faster and more effective, preserving the right to peace and preventing the situation from becoming an endless cycle of police calls.
And you, have you ever faced problems with neighbor noise? Did you manage to resolve it through conversation or did you need to resort to the Justice system? Leave your experience in the comments — your opinion may help others deal with the same challenge.
