A rule that remains valid in 2026 continues to directly influence the road transport sector in Brazil.
The point limit for suspension of the CNH is not fixed and, since the update applied in 2021, has varied according to the history of serious infractions recorded in the last 12 months.
Thus, the ceiling can reach 40 points, but it can also fall to 30 or 20 points, depending on the driver’s conduct.
As a consequence, professionals who depend on the license to work need to double their attention to avoid interruptions in their activity.

This dynamic especially impacts drivers who work in cargo transport, deliveries, and urban mobility.
Therefore, understanding how the scoring system works has become part of the operational planning of many companies.

How The Point Limit Influences Drivers and Logistics Operations

Currently, the model considers exclusively the number of serious infractions accumulated over 12 months.
In this way, three scenarios are applied.

First, those who do not record serious infractions can reach up to 40 points before suspension.
Next, with one serious infraction, the limit is reduced to 30 points.
Finally, when there are two or more serious infractions, the ceiling drops to 20 points.

For companies that depend on active drivers, this reduction can affect schedules and delivery deadlines.
Additionally, each suspension necessitates internal reorganization.

However, there is a relevant exception for the productive sector.
Drivers with the note EAR (Exerces Paid Activity) maintain a fixed limit of 40 points, regardless of the number of serious infractions.
Thus, the rule seeks to preserve the continuity of work for those who drive professionally.

The system continues to be organized by categories, and each infraction generates corresponding points and fines.

Light infractions add 3 points and a fine of R$ 88.38.
Medium infractions accumulate 4 points and a fine of R$ 130.16.
Severe infractions record 5 points and a fine of R$ 195.23.
Meanwhile, serious infractions generate 7 points and a fine of R$ 293.47.

Furthermore, some serious infractions have a multiplier factor.
In these cases, the value can exceed R$ 2,900.00, which amplifies the financial impact.

For the logistics sector, this scenario means additional costs and possible disengagement of professionals.
Consequently, companies tend to reinforce training and conduct monitoring.

Infractions That Immediately Suspend The CNH and Affect Operations

In addition to the accumulation of points, there are conducts that provoke direct suspension.
In these situations, the CNH is automatically suspended, regardless of the points.

Among them are driving under the influence of alcohol, refusing the breathalyzer, exceeding the speed limit by more than 50%, and participating in street racing.
When this occurs, the driver is removed, and the operation needs to be reorganized.

Therefore, operational risk increases when there is recurring negligence.

Digital Control Aids Planning and Management

Currently, the points can be checked through the app Digital Driver’s License (CDT).
Thus, both drivers and companies can monitor the situation in real-time.

Additionally, it is important to remember that points expire individually after 12 months from the infraction.
They are not automatically reset at the beginning of the year.

In this way, the variable model of 20, 30, and 40 points does not only affect the driver individually.
It also influences productivity, the continuity of operations, and the planning of the road transport sector in 2026.
