Penalty Could Have Been Maximum, Excluding Five Years Without Participating in Federal Public Administration Bids, but TCU’s Suspension Was One Year.
TCU (Court of Accounts of the Union) declared UTC Engenharia ineligible to participate, for a period of one year, in bids within the federal public administration, which includes Petrobras competitions.
The company was trying to defend itself after being indicted by the investigations of Operation Car Wash, which found fraud in the bids conducted by Petrobras.
The company’s main involvement was in the Rnest works, the Abreu e Lima Refinery in Ipojuca/PE, belonging to Petrobras. Although the company has responded in civil and criminal actions, the TCU’s administrative suspension was based on the evidence found in the processes.
Minister Benjamin Zymler, rapporteur of the TCU, made the decision after analyzing the company’s proposals in the bid, but on the other hand, considered the company’s collaboration with the public authority and the leniency agreement signed by the TCU.

Thus, UTC Engenharia was spared the maximum penalty, which was five years without participating in federal administration bids, including Petrobras, and was declared ineligible for one year.
The Federal Police indicted three executives of UTC Engenharia. Executives Ricardo Pessoa, Ednaldo Alves da Silva, and Walmir Pinheiro Santana are identified as responsible for the crimes. All were detained by Operation Car Wash.
