TJ-MG Ruling Recognizes Violation of Rights and Orders Compensation for Moral Damages After Lock Change and Forced Eviction.

The Justice of Minas Gerais ordered the payment of compensation to a woman expelled from her home by her own uncle, with whom she shared a property inherited from their grandmother. The decision was made by the 11th Civil Chamber of the Court of Justice of Minas Gerais (TJ-MG), which overturned a first-instance decision and set the compensation at R$ 6,000.

According to Conjur, the case involved changing the apartment locks and placing the niece’s belongings in bags on the sidewalk, preventing her from returning to the residence.

The incident prompted the victim to file a police report and initiate legal action to recover her rights.

What Happened

The conflict began in 2021, when uncle and niece started sharing the inherited property. Without a formal agreement on the division, the uncle decided to act on his own: he changed the locks and put all the niece’s belongings outside the apartment.

The man’s defense claimed that the situation would constitute only “a minor inconvenience” and that there was no obligation for moral compensation.

It also argued that the niece could have initiated the inventory since both were heirs. Nevertheless, the court understood that the conduct exceeded the limits of coexistence.

The Court’s Analysis

In the ruling, Judge Shirley Fenzi Bertão emphasized that the woman had always lived in the property with her grandmother and that her exclusion constituted a direct violation of the right to housing.

For the magistrate, the sudden deprivation and public exposure of the belongings constituted unjust embarrassment and damage to the victim’s dignity.

The vote of the rapporteur was supported by judges Rui de Almeida Magalhães and Marcelo Pereira da Silva, consolidating the decision of the 11th Civil Chamber.

The understanding reinforces that, as long as there is no inventory, the property remains in condominium and cannot be unilaterally appropriated by one of the heirs.

Legal Consequences

The case illustrates how inheritance disputes can turn into intense legal battles. Without a formal inventory and division, no heir has exclusive rights to the property.

The attempt to evict another co-owner may constitute an abuse of rights and lead to compensation, as occurred in this case.

Experts emphasize that hasty actions can not only result in financial penalties but also permanently tarnish familial relationships.
