Even Without Formal Registration, The Law Ensures That Unregistered Rural Workers Have Access To Labor And Social Security Benefits, Such As FGTS, Vacation, Thirteenth Salary, And Even Retirement, According To Experts From VLV Lawyers

The unregistered rural worker often believes that they lack legal protection, but the reality is different. Under Brazilian law, the employment relationship does not solely depend on formal registration: it suffices to prove that the activity was carried out continuously, for remuneration, and under the authority of an employer. This means that even without registration in the CTPS, the employee may be entitled to receive retroactive amounts and count time toward retirement.

According to VLV lawyers, the Labor Court takes the reality of work above the absence of registration. This opens the door for rural workers to assert their rights and secure not only overdue wages but also future benefits, such as rural retirement and access to INSS.

What Characterizes The Employment Relationship In The Field

By law, anyone who performs activities on rural properties—whether in harvesting, planting, livestock breeding, or other typical functions—habitually, for remuneration, and under the orders of an employer is considered a rural worker.

These characteristics define the employment relationship and therefore require the employer to register the worker.

When this does not occur, the relationship continues to exist but in an irregular manner, allowing rights to be claimed in court.

Basic Rights Guaranteed Even Without Formal Registration

According to VLV lawyers, the unregistered rural worker does not lose their labor rights.

The court may require the employer to pay:

Minimum wage or category wage floor

Proportional thirteenth salary

Vacation with an additional 1/3

Retroactive FGTS deposits

Hazard or unhealthy work premiums, when applicable

It is possible to request social security benefits such as sickness aid, maternity salary, rural retirement, and death pension, provided there is proof of the activity.

How To Prove Rural Work Time

The absence of registration does not prevent proof.

The worker can use various documents, such as production invoices, declarations from rural unions, lease contracts, certificates, school histories of children in rural areas, in addition to witnesses.

These pieces of evidence serve to demonstrate the activity and ensure that rights are recognized.

The more robust the set of evidence, the higher the chances of success in a judicial action or social security request.

Ways To Assert Rights

When the employer does not register the rural worker, they can be reported to the Ministry of Labor, the union of the category, or directly sued in the Labor Court.

According to experts, legal action can guarantee the retroactive payment of wages, vacation, thirteenth salary, and FGTS, in addition to the recognition of the employment relationship.

This recognition also serves to ensure that the time is counted for INSS, which is essential for retirement.

The deadline to file a labor lawsuit is up to two years after the end of the contract, but only amounts corresponding to the last five years can be claimed.

Therefore, acting quickly is essential to avoid losing important amounts.
