How to Regularize After Exceeding the Annual Revenue Limit of MEI
To avoid complications, Sebrae recommends that the MEI monitor monthly revenue. If they identify that they will exceed the limit, it is advisable to request disqualification by the last business day of the month following the excess, which reduces the risk of fines.
In the Microenterprise regime, taxes are calculated based on annual revenue and the Simples Nacional tables. This requires greater financial control and, in many cases, hiring an accountant to monitor the process.
Annual Declaration and Obligations of MEI
Even after exceeding the limit, the microentrepreneur must submit the Annual Declaration of Simples Nacional (DASN-SIMEI) by May 31. The document gathers information about the revenue from the previous year and any employees.
Those who do not submit the declaration on time pay a fine of 2% for each month of delay, limited to 20% of the total due, with a minimum amount of R$ 50. Additionally, there may be cancellation of the CNPJ if monthly contributions are not paid for two consecutive years.
If any information is submitted incorrectly, it is possible to send a corrective declaration, correcting the information in the system and generating a new transmission receipt.

O limite anual de R$81.000 é ridículo, considerando o valor e custos de produtos e serviços atualmente. Eu acredito que, no mínimo, deveria ter uma flexibilidade nos cenários para quem ultrapasse o limite anual, por exemplo, pagar uma guia específica somente no ano em que exceder o teto, sem desenquadramento, porque pode ser uma exceção e não será recorrente.
